- This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT using Federal Acquisition Regulation (FAR) Part 13.106-1(b), for Other than Full and Open Competition. The Army Contracting Command-Aberdeen Proving Ground, Aberdeen Installation Contracting Division, 4118 Susquehanna Avenue, Aberdeen, MD 21005 has a requirement to procure the following items: Environmental Container Systems, Inc.(ECS) TCS Legacy Rack Mount Cases for Aberdeen Testing Center (ATC) to support Data Acquisition Systems for Live Fire Survivability Testing. Under the authority of FAR 13.106-1(b)(1), Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization), the Government intends to award a Firm-Fixed Price sole source contract to Environmental Container Systems, Inc; 3560 Rogue River Highway: Grants Pass, OR 97527. USA Aberdeen Test Center has a requirement for Legacy Rack Mount Cases to support Data Acquisition Systems for Live Fire Survivability Testing. ECS Composites is the sole manufacturer of these Composite Rack Mount Shells and possesses the proprietary design and fabrication technology for their manufacture. The associated North America Industry Classification System (NAICS) Code is 326199 and the Business Size Standard is 500 employees. Contractors interested in this requirement should submit a complete technical package, which provides clear and convincing evidence that they can meet the Government's requirement. This notice of intent is not a request for competitive proposals. However, the Government will consider all responses received by the response date stated above. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Telephone requests will not be honored. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses must be received no later than 12:00 p.m., Eastern Daylight Time, March 9, 2012. Responses should be submitted via e-mail to jason.zahnley@us.army.mil.
