52.212-3 Offeror Representations and Certifications—Commercial Items (MAY 2011) 52.204.3 Taxpayer Identification Description(s): THIS PROCUREMENT IS SET-ASIDE FOR SMALL BUSINESS CONCERNS. The Contractor shall provide Substance Abuse Coordinator Consultant Services to the Billings Area, Indian Health Service, and Office of Health Care Program. Billings, Montana. The procurement is conducted pursuant to the authority of Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures; and FAR 37.104(b), Personal Services Contract (Public Law 103-332, Department of the Interior and Related Agencies Appropriation Act, Title II, September 30, 1994, 108 Stat. 2530 as implemented by U.S.C. 1638c). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Billings Area Indian Health Service (IHS) intends to award a fixed-price purchase order in response to Request for Quotation (RFQ) 10-12-036-JH. This solicitation is restricted to 100% Small Business concerns. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-53. The associated North American Industry Classification System code is 541618 and the small business size standard is $7.0 million. This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. Prospective contractors are requested to provide an daily rate. PRICE SCHEDULE - Substance Abuse Coordinator Consultant: 1200 hrs. @ $_______________per=$__________________. Travel / Site Visits to Service Unit's @ $__________per=$_________________. STATEMENT OF WORK: The purpose of this acquisition is to contract for a Substance Abuse Coordinator Consultant to provide support, strategic planning, develops practice management standards, administrative responsibility and clinical guidance to the Billings Area Indian Health Service, Office of Health Care Alcohol/Substance Abuse Program and P.L. 93-638 Tribal Substance Abuse contracts/programs. The Reservation program include: Blackfeet Crystal Creek Lodge; Browning, Montana; Crow; Crow Nation Wellness Center, Crow Agency, Montana; Fort Belknap Chemical Dependency Center, Harlem, Montana; Fort Peck Spotted Bull Treatment Center, Fort Peck Transitional Living Unit for Youth, Poplar, Montana; Northern Cheyenne Recovery Center, Lame Deer, Montana; Northern Arapahoe White Buffalo Recovery Center Arapahoe, Wyoming. Eastern Shoshone, Recovery Center, Fort Washakie, Wyoming. SCOPE OF WORK : (1) The contractor will coordinate comprehensive strategic planning training for all of the programs and will provide the follow up to ensure that the programs are accomplishing their established goals and objectives. In addition, this strategic plan will help to further define and set the stage for more consistent scopes of work for the contract fiscal year 2013. (2) Work in conjunction with the Indian Health service Behavior Health Officer and the tribal SA Directors to develop and implement culturally specific practice management standards/protocols intended to guide programs in a more consistent delivery of services to their communities that result in greater measurable and improved outcomes. (3) Assist programs in gaining greater proficiency in critical service areas, such as consistent application of assessments, justified service placement, individualized treatment planning, accurate progress tracking and follow up. (4) Work with Area and Tribal programs to explore the feasibility of developing a Native American-based training and treatment curriculum in conjunction with the other educational based programs. (5) Work with the Tribal SA Directors to ensure that their staff has access to ongoing training in the use of their current software system. (6) Work with the Indian Health Service Behavior Health Officer and Tribal SA Directors to coordinate training in the area of clinical supervision. (7) Work in conjunction with the Indian health Service Behavior Health Officer and the Tribal SA Directors and the RPMS report format to Clearly define what reporting criteria and timelines are necessary to satisfy the contract requirements and what criteria is most important to the communities they serve. (8) Work with the Indian Health Service Behavior Health Officer and the Tribal SA Directors to develop the Tribal substance abuse program evaluation tool in a manner that allows the evaluations to better reflect how programs are meeting contract requirements and the community need. (9) Travel required as needed to provide on-site assistance, training, workshops, conferences and related meetings. (10) The contractor will be required to work on-site at the Billings Area Indian Health Service Office, Billings, Montana. KNOWLEDGE REQUIRED BY POSITION: Expert knowledge and advance counseling skills in the field of substance abuse and co-occurring disorders such as would be required with an advanced degree in an accredited graduate program in psychology, addictions or marriage and family therapy. Knowledge of best practices in the field of substance abuse treatment obtained in a treatment setting such as and outpatient services or inpatient services. Expert experience in administrative, supervisory, consultative and technical work related to the development and improvement of program operations. Export knowledge and experience in provision of integrated services to American Indian patients with addictive and mental health disorders. Demonstrated administrative experience at one of the multiple levels of the Indian Health Service structure such as Headquarters, Area or Tribal level and knowledge of federal procurement/contracting process, program operations, including budgetary process, Title I and Title III of the Indian Self Determination Act or equivalent outside experience. Knowledge of National Standards in substance abuse treatment, JCAHO, and CARF, as well as Indian Health Service manual Chapter 18. Advanced skills in electronic patient records, generations of reports, work processing, excels spread sheets, creation of excel templates for generation of graphs and charts, e-mail and power point presentations. Expert in communication skills, public speaking, ability to explain, advocate, and express facts and ideas in a convincing manner to a wide variety of audiences, and to negotiate with individuals and groups internally and externally. PERIOD OF PERFORMANCE: The performance of this contract shall be from Award Date, through December 31, 2012 SUPERVISORY CONTROLS: The Behavioral Health Consultant, Billings Area Office, Indian Health Service, provides general administrative direction that includes agency goals and directives that are broadly defined. Incumbent is given broad discretionary powers and independent authority to accomplish general objectives and specific projects. The incumbent plans, prioritizes own work and provides direction to the support staff for accomplishing clerical services. The incumbent selects methodology and consults experts and other resources as needed. In addition, the incumbent assesses program needs and problems, plans, designs and carries out studies in concert with the Area Behavioral Health Consultant, OHCP and ITU leadership and program staff. Incumbent carries out assignments with a high degree of autonomy and independence. Incumbent is recognized as an authority on substance abuse and co-occurring disorders. Work is evaluated on effectiveness in meeting broad objectives, timeliness, evidence of effective leadership and quality of technical information. Annual performance ratings are completed by the Area Behavioral Health Consultant with input from ITU leadership. GUIDELINES: Incumbent refers to biological, neurological and psychological science, current findings in the literature, and standards of practice, Area specific plans, Area Director SES contract performance indicators and Government Performance Results Act (GJ.PRA), and uses legislation (federal state, tribal), regulation, agency policy, accreditation body standards, and national professional standards that may or may not be specific to the ITU programs. Those guidelines require continuous interpretation, adaptation to a rural, trans-cultural setting, and application to conform to changes in the field of substance abuse/ mental health programs COMPLEXITY: The work requires expert clinical knowledge and specialty training that is applied to a broad range of health problems that have psychiatric, addiction, cultural, medical and social determinants. Understanding of Al/AN community concerns must be applied in program design and development. A wide knowledge of resource management, including federal, state and tribal resources, must be applied in development of comprehensive services. Cooperation with multiple agencies is required for program maintenance and enhancement. The complexity of the position is impacted by the variety of health care disciplines, number of federal, state, local and tribal agencies that are interfaced, diversity of the population served, remoteness of facilities and programs, and the variety and number of health care problems that have behavioral components. SCOPE AND EFFECT: The purpose of work is to provide expert program consultation to primary care, mental health and substance abuse staff located in rural and urban knowledge and research to the ITU leadership. Incumbent has input on broad policy. Development and program planning aimed at creating a fully integrated system of mental health and substance abuse services. The incumbent actively networks with state and federal agencies, conducts program studies and maintains an active consultation process with the Behavioral Health programs throughout the Area. This incumbent impacts funding, staffing, program expansion throughout the Area ITU leadership of the entire spectrum of mental health, substance abuse, social services and other behavioral health related programs such as diabetes and injury prevention. PERSONAL CONTACTS: Contacts are complex and involve professional and professional primary care providers, licensed addiction counselors, psychologists, licensed clinical social workers, local state and tribal officials, local program coordinators and administrators, Federal, State, County, and local program staff and administrators, IHS Headquarters staff, and staff within the Billings Area Office. Personal contacts involve multiple levels of the ITU, government agencies at the federal, state and local levels, tribal elected leaders, clinicians, scientists, media, students who are in bachelors, masters and doctoral level studies, clients and families. PURPOSE OF CONTACTS: The purpose of contacts is to provide expert knowledge from the field of addictions treatment to enhance mental health and substance abuse programs throughout the Area ITU; to provide cross training to all members of the mental health and substance abuse programs, to gather current information regarding need based on statistical and scientific studies; to represent ITU programs to health care providers, state and federal agencies and to implement tribal consultation in the development of initiatives of the Area Substance Abuse and Co-occurring Disorders. Further, the purpose of contacts is to acquire and disseminate information by lectures and public speaking, to develop policy statements and reports, to participate in committees, conferences, seminars and workshops, facilitate collaboration between the various disciplines and programs of the Area Behavioral Health program. PHYSICAL DEMANDS: Work is conducted primarily in an office setting either in the Area office or in local program offices. Other demands are driving, air travel, use of computers, and standing for presentations. Work involves traveling by car, and air common carrier to attend meetings, to provide training and to conduct onsite program consultations or reviews as requested. Rarely, the incumbent may spend up to a week or more in travel status to provide training or to address a crisis situation. Driving in winter conditions is sometimes required. Must possess and maintain a valid, unrestricted state driver's license. WORK ENVIRONMENT: The primary work environment is the office located in the Billings Area Office. However, work is also conducted in Montana and Wyoming Indian health hospitals and clinics, tribal program offices and the offices of other state and federal agencies. Work via telecommunications technology is an evolving environment in which program work is conducted. Work involves interaction with multiple levels of program and management staff. Travel by air and automobile is required which carries the normal risks associated with travel of any kind. The work environment includes meeting and interacting with a wide variety of people and with large groups of people. The work environment includes use of telecommunication and computer equipment. The position requires knowledge of, or sensitivity to, cultural and language differences, local social and political conditions, and modes of operation of other agencies. Much of the success of the Substance Abuse and Co-occurring Disorders program depends on the incumbent's skill in handling contacts with clinic staff, other agencies, and groups and with patients and families. GOVERNMENT FURNISHED PROPERTY: The primary work environment is the office located in the Billings Area Office. However, work is also conducted in Montana and Wyoming Indian health hospitals and clinics, tribal program offices and the offices of other state and federal agencies. Work via telecommunications technology is an evolving environment in which program work is conducted. Work involves interaction with multiple levels of program and management staff. Travel by air and automobile is required which carries the normal risks associated with travel of any kind. The work environment includes meeting and interacting with a wide variety of people and with large groups of people. The work environment includes use of telecommunication and computer equipment. The position requires knowledge of, or sensitivity to, cultural and language differences, local social and political conditions. FEDERAL TRAVEL REGULATION: The services that the contractor will be providing to the IHS may require that the contractor occasional travel and training that will be authorized pursuant to Federal Travel Regulations. The Federal Tort Claims Act: For medical related claims is extended to the individual providing services pursuant to this contract. The services performed must have been within the scope of the Personal Services contract. The FTCA provides a limited waiver of the federal government's sovereign immunity when its employees are negligent within the scope of their employment. Under the FTCA, the government can only be sued 'under circumstances where the United States, if a private person, would be liable to the claimant in accordance with the law of the place where the act or omission occurred.' 28 U. S.C. S 1346(b).Thus, the FTCA does not apply to conduct that is uniquely governmental, that is, incapable of performance by a private individual. 28 U.S.C.S 2680(h) provides that the government is not liable when any of its agents commits the torts of assault, battery, false imprisonment, false arrest, malicious prosecution, abuse of process, libel, slander, misrepresentation, deceit, or interference with contract rights. However, it also provides an exception. The government is liable if a law enforcement officer commits assault, battery, false imprisonment, false arrest, abuse of process, or malicious prosecution. The government s not liable if the claim against law enforcement officers is for libel, slander, misrepresentation, deceit, or interference with contract Congress has not waived the governments sovereign immunity against all law enforcement acts or omissions. Service Contract Act of 1965 as Amended: FAR 52.222-41 Service Contract Act of 1965 as Amended. Service contract" means any Government contract, the principal purpose of which is to furnish services 1n the United States through the use of service employees, except as exempted under section 7 of the Aot (41 U.S.C. 356; see 22.1003-3 and 22.1003-4), or any subcontract at any tier there under. See 22. 1003-5 and 29 CFR 4. 130 for a partial list of services covered by the Act. Service contracts over $2.500 shall contain mandatory provisions regarding minimum wages and fringe benefits, safe and sanitary working conditions, notification to employees of the minimum allowable compensation, and equivalent Federal employee classifications and wage rates. Under 41 U.S.C.353 (d), service contracts may not exceed 5 years. No contractor or subcontractor holding a service contract for any dollar amount shall pay any of its employees working on the contract less than the minimum wage specified in section 6(a)(1) of the Fair Labor Standards Act (29 U.S.C. 206). FAR 52.237-7 Indemnification and Medical Liability Insurance (JAN 1997): (a) It is expressly agreed and understood that this is a non-­ personal services contract, as defined in Federal Acquisition Regulation (FAR) 37.101, under which the professional services rendered by the Contractor are rendered in its capacity as an independent contractor. The Government may evaluate the quality of profess oral and administrative services provided, but retains no control over professional aspects of the services rendered, including by example, the Contractor's professional medical judgment, diagnosis, or specific medical treatments. The Contractor shall be solely liable for and expressly agrees to indemnify the Government with respect to any liability producing acts or omissions by it or by its employees or agents. The Contractor shall maintain during the term of this contract liability insurance issued by a responsible insurance carrier of not less than the following amount(s) per specialty per occurrence:.(b) An apparently successful offeror, upon request by the Contracting Officer, shall furnish prior to contract award evidence of its insurability concerning the medical liability insurance required by paragraph (a) of this clause. (c) Liability insurance may be on either an occurrences basis or on a claims-made basis. If the policy is on a claims-made basis, an extended reporting endorsement (tail) for a period of not less than 3 years after the end of the contract term must also be provided. (d) Evidence of insurance documenting the required coverage for each health care provider who will perform under this contract shall be provided to the Contracting Officer prior to the commencement of services under this contract. If the Insurance is on a claims-made basis and evidence of an extended reporting endorsement is not provi ded prior to the commencement of services, evidence of such endorsement shall be provided to the Contracting Officer prior to the expiration of this contract. Final payment under this contract shall be withheld until evidence of the extended reporting endorsement is provided to the Contracting Officer. (e) The policy is evidencing required Insurance shall also contain an endorsement to the effect that any cancellation or material change adversely affecting the Government's interest shall not be effective until 30 days after the Insurer or -the Contractor gives written notice to the Contracting Officer. If, during the performance period of the contract the Contractor changes Insurance providers, the Contractor must provide evidence that the Government will be indemnified to the limits specified in paragraph (a) of this clause, for the entire period of the contract, either under the new policy, or a combination of old and new policies. (f) The Contractor shall insert the substance of this clause, including this paragraph (f), in all subcontracts under this contract for health care services and shall require such subcontractors to provide evidence of and maintain insurance in accordance with paragraph {a) of this clause. At least 5 days before the commencement of work by any subcontractor, the Contractor shall furnish to the Contracting Officer evidence of such insurance. The Privacy Act of 1974: The Act mandates that the Contractor shall maintain complete confidentiality for all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge e. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation such confidentiality shall be cause for adverse action. The HIS shall provide training on the Freedom of Information Act (as amended) and the Privacy Act. All HIS regulations and policies applicable to these acts shall be enforced. COMPUTER SECURITY: Pursuant to the Federal Information Security Management Act of 2002 (FISMA), the contractor will be required to complete a course in Computer Security Awareness Training (CSAT). This training must be completed annually by all employees including all contractors. The Contractor will be required to comply with the Federal Information Processing Standards Publication (FIPS PUB) Number 201, "Personal Identity Verification of Federal Employees and Contractors," and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification for all affected contractor and subcontractor personnel. REPORTING REQUIREMENTS: The Contractor shall provide the Contracting Officer with evidence that payment of employment taxes has been made 15 days after each quarter. CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. PROJECT OFFICER: The project officer shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the Supervisor. The Contractor agrees to include the following information on each invoice: (1) Contractor's name and address; (2) Contract Number; (3) Invoice number and date; (4) Dates of Service including the number of hours worked and total amount due; and (5) Remit to address. Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107. PERFORMANCE-BASED SERVICE CONTRACTING Performance-based contracting methods are intended to ensure that required performance quality levels are achieved and that total payment is related to the degree that services performed meet contract standards. PERFORMANE OBJECTIVE Statement of Work Paragraph. PERFORMANCE STANDARD METHOD OF SURVEILLANCE DEDUCTION SCHEDULE Provides expert leadership and consultation to Area and Tribal managers regarding substance abuse and co-occurring Disorders. Works with the Area Behavioral Health Consultant to implement integrated Behavioral Health program services, standards, policies and evidence based practices. Plans, develops and implements broad initiatives to address Social and lifestyle issues. Develops and assists Tribes in implementing program policies, practice guidelines, licensure requirements and Program certification to elevate and expand services provided by local programs. Maintains Wide liaison network with tribal, state, federal agencies and regulatory bodies to fulfill agency goals and vision. SOW: Provide services as specified in Performance work statement Reviews and conferences with contractor and Project manager. 5 % Deduction from their monthly invoice. Provides reports to Tribal and IHS leadership regarding gaps in service, workload, revenue enhancement and areas of need, such as position descriptions consistent with provision Of treatment for addiction disorders. Performance work statement. Provides expert advice on compliance and ethical issues and arranges for outside reviewers as indicated. Oversees development of organizational structure and position descriptions consistent with delivery of a full range of substance abuse and co-occurring disorders services which are based on a recovery oriented system of care. Provides or Works with medical, psychological, addiction and prevention specialists to address emerging problems new to the state and Reservation communities. Involves best practice researchers and providers for training of staff. Advises staff on program strategy to implement change. PRO-CHILDREN ACT OF 1994: The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded children's services are provided. CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI). A CNACI must be completed for all Indian Health Service (IHS) contractor personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, require the IHS to conduct a character and criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations will be conducted by the Billings Area IHS Office. Fingerprints must also be taken as part of the pre-employment process and must be completed before the Chemical Dependency Consultant is allowed to work. The fingerprint check should be coordinated with the Billings Area Administrative Specialist. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offers' Commercial Items; and 52.212-3 Offeror Representations and Certifications Commercial Items are incorporated by reference. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 EVALUATION COMMERCIAL ITEMS (JAN 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. THE CONTRACTOR SHALL PROVIDE EVIDENCE OF, OR SUBMIT A WRITTEN RESPONSE TO, THE FOLLOWING EVALUATION FACTORS. The following factors shall be used to evaluate offers: (1) Knowledge of Chemical dependency treatment program policies = 15 Points; (2) Knowledge of ASI assessment criteria, ASAM placement criteria, MIS systems including ACCUCARE, state certifications standards, Indian Health Service Manual chapter18, CARF standards and experience in implementation = 20 points. (3) Skill in problems identification and resolution at the program level in reservation-based programs = 25 points. Experience = 25 Points; (4) Clinical experience in screening, assessment, intervention and rehabilitation of chemically dependent clients who have co-occurring addition and medical problems = 20 points. (5) Experience as a consultant to chemical dependency treatment programs providing technical assistance, program evaluation, in-service education and written reports. Licensure and/or educational background in behavioral sciences; Psychology, Counseling, Addictions, or Social Work = 20 points. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. BASIS FOR AWARD; E.G., Technical and past performance, when combined, are approximately equal to cost or price. PROPOSAL SUBMISSION INSTRUCTIONS: The Contractor shall provide evidence of, or submit a written response to, the technical evaluation factors in FAR 52.212-2. In addition, the Contractor shall submit a completed copy of FAR 52.212-3 with its offer. All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted to the Billings Area Indian Health Service, 2900 Fourth Avenue North, Room 304, Billings, Montana 59101, no later than 4:30 p.m., on March 9, 2012. The offer must be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your name and address. Offers will also be accepted by e-mail at james.hunter@ihs.gov or by fax at (406) 247-7108. ACCEPTANCE PERIOD: Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFQ.
