Description
The Social Security Administration (SSA) intends to negotiate solely with Data Processing Techniques, Inc. (DPT) located at 943 Northfield Road, Woodmere, New York 11598 for continued software maintenance for Government-owned Partitioned Data Sets (PDS) Monitor software products under the authority of Federal Acquisition Regulation (FAR) 6.302-1 "Only one responsible source and no other supplies or services will satisfy agency requirements." PDS Monitor software is proprietary to the manufacturer, Data Processing Techniques, Inc. (DPT). DPT does not have any authorized resellers and, is therefore, the only source from which SSA can purchase the required SW subscription. Proprietary software is software that only the legal owner of the software code can maintain because no one else has access to the code. Therefore, no one else can fix it and there are no authorized resellers. This maintenance is required in the form of a subscription with updates and improvements as they are issued and 24/7/365 telephone support. SSA intends to establish a firm fixed-price purchase order for continued maintenance on this proprietary software, currently installed and operating at SSA's National Computer Center (NCC) in Baltimore, Maryland and Durham Support Center (DSC) in Durham, North Carolina. The period of performance shall be for 12 months, starting May 1, 2012. Written responses to this Notice shall contain sufficient documentation to establish a bona-fide capability to fulfill this requirement. A solicitation is NOT available. Therefore, the Government will not honor written and/or verbal requests for copies of a solicitation related to this announcement. A determination by the Government not to compete this proposed order based upon responses to this notice is solely within the discretion of the Government. Based on the information received, the Government will determine whether to conduct a competitive procurement. The Government will NOT notify Respondents of the results of the information received. You must submit your responses to this notice by February 3, 2012 at 10:000 A.M. EST. You may send responses via E-MAIL ONLY to the point of contact listed below.
