- This is a combined Synopsis/Solicitation/Notice of Intent for commercial items prepared in accordance with the format of FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are not being requested, and a written solicitation will not be issued for the solicitation number NIAID-NOI-12034. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC2005-55 dated January 3, 2012. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is a small business set-aside. The associated North American Industry Classification System (NAICS) Code is 541380, which has a size standard of 12.0 in millions of dollars. The National Institute of Allergy and Infectious Diseases (NIAID) intends to procure on a sole source basis from ACGT Inc. DNA production and Identity Verification of five (5) plasmid DNAs under GLP: 1) CMV/R Perth/16/2009 HA; 2) CMV/R Perth/16/2009 NA; 3) pHR-CMV Luciferase; 4) pCMV-R8.2 Luciferase; and 5) SG3DeltaEnv, with project planning, project tracking, data analysis and troubleshooting, preparation and delivery of the Preliminary and Final reports and files. ACGT is the only vendor who can provide material and services for a continuation under the Protocol Universal Influenza Vaccine on-going study. Failure to use ACGT by replacing with another product would result in significant additional cost and time delays in trying to restart study. Any attempt to change reagents for this particular application would prove results inconsistent with previously gathered data. By utilizing ACGT in the field of the familiarity of DNA vector generation, validation and Molecular Biology, the lab will reduce in-house DNA vector development times and overall reduce time in providing faster results that will help aid in the design and generation of effective vaccines. Delivery shall be for 30 days from date of award to Gaithersburg, Maryland 20878. The following factors shall be used to evaluate offers: 1) capability to meet required specifications, 2) price, and 3) delivery. The government will award a fixed price purchase order to the responsible contractor. The FOB terms are 'Destination' and Net 30. FAR provisions and clauses that apply to this acquisition: FAR 52.212-1, Instructions to Offerors, Commercial Items; FAR 52.212-2, Evaluation - Commercial Items; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes of Executive Orders - Commercial Items; and FAR 52.232.33, Payment by Electronic Funds Transfer-Center Contractor Registration (Oct 2003). In order to be considered for an award, an Offeror must have completed the online electronic Representations and Certifications located at http://orca.bpn.gov/ in accordance with FAR 4.1201 (a). By submission of an offer, the Offeror acknowledges the requirement that a prospective Awardee shall be registered in the CCR at www.ccr.gov prior to award during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation. [Note: Lack of registration in the Central Contractor Registration will make an Offeror ineligible for award.] All responsible sources may submit an offer that will be considered by the Agency.
