Description
Court Order 1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: Requesting Agency: USDA, APHIS, AC 4700 River Road, Unit 84 Riverdale, Maryland 20737 Contracting Activity: USDA, APHIS, MRPBS, ASD Minneapolis Procurement Branch Butler Square, 5th Floor 100 North 6th Street Minneapolis, MN 55403 2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED: Through a Consent Decision and Order, signed by a USDA Administrative Law Judge on October 31, 2011 (see attached), APHIS now owns approximately 115 Macaques (i.e., monkeys) located at the Wild Animal Orphanage, a licensed exhibitor in San Antonio. APHIS has agreed, through the Consent Decision and Order, to transfer ownership of the Macaques to Born Free, a sanctuary near San Antonio, when Born Free has completed the construction of new housing for the Macaques. APHIS agreed to arrange for and pay the costs of the following prior to the transfer: • Sterilization of each male Macaque; • Vaccination of each Macaque against tetanus; • Screening of each Macaque for tuberculosis; • Fecal screening and baseline blood work for each Macaque; and • Tattooing of each Macaque. The above action was necessary in order to prevent APHIS from pursuing confiscation of the macaques and the likely position of having to euthanize all of them due to inability to place the animals. 3. A DESCRIPTION OF THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED TO MEET AGENCY NEEDS (INCLUDING THE ESTIMATED VALUE OF THE ACQUISITION INCLUSIVE OF OPTIONS): Dr. Kirk, owner/operator of Falling Rock Veterinary Clinic, and a veterinarian from Primarily Primates (a sanctuary not required to be licensed under the Animal Welfare Act) will be responsible for overseeing on behalf of APHIS, the procedures listed in the Consent Decision and Order. Welfare of the animal being our primary concern, in order to prevent un-due stress on the animals, the tuberculosis test will be completed at the same time the animals have been sedated for castration. People work with Macaques every day. Proper handling of these animals is extremely important. This brings with it the need to have a trained team of experts carry out this work. Dr. Kirk has the appropriate level of expertise and local facilities to make this happen. 4. IDENTIFICATION OF THE STATUATORY AUTHORITY PERMITTING NONCOMPETITIVE ACQUISITIONS: The statutory authority is 41 U.S.C. 253( c )(1) 5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED: The services must be provided by a veterinarian that possesses extensive experience conducting the procedures on Macaques as outlined in the Consent Decision and Order. It is also in the best interest of the Government to select an individual local to the situation to eliminate travel costs and/or transportation of the Macaques. Proper handling of these animals is extremely important, as Macaques are natural carriers of the Herpes-B virus, and untreated infection with this virus is fatal in humans. Dr. Kirk has the appropriate level of expertise needed to carry-out this delicate situation. 6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS, OR WILL BE, PUBLICIZED AS REQUIRED BY FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2, AND IF NOT, WHICH EXCEPTION UNDER FAR 5.202 APPLIES: Animal Care's knowledge of the facilities with Macaques, both regulated and unregulated, in the San Antonio area allowed us to know the veterinarians that met the necessary criteria. APHIS has been providing technical support to Wild Animal Orphanage for over one year, working with industry groups and sanctuary groups. The bankruptcy and pending closure of Wild Animal Orphanage have been well publicized. As we performed research on other veterinarians qualified to perform the procedures, we found them to be prohibited sources due to their affiliation with facilities regulated under the Animal Welfare Act. 7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE, AND THE BASIS FORTHAT DETERMINATION: The price is fair and reasonable based on a detailed cost breakdown of equipment, supplies, and hourly rates for the service as compared to similar services and internal price estimates. 8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (FAR ART 10) AND THE RESULTS, OR AN EXPLANATION OF THE REASON MARKET RESEARCH WAS NOT PERFORMED: Our market research resulted in qualified personnel that are considered prohibited sources due to their affiliation with facilities we regulate under the Animal Welfare Act. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION FAR 6.303-2(a)(9): Veterinarians that are experienced enough to conduct the procedures listed above on Macaques, and, that don't work for a facility regulated under the Animal Welfare Act are rare. Given the Consent, Decision and Order, this situation must be handled by individuals the industry (animal welfare organizations) trust. Dr. Kirk has established that trust when it comes to the proper care and safe handling of macaques. 10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITON: N/A 11. A STATEMENT OF THE ACTIONS, IF ANY. THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED: Since this is one time service there are no further actions required. 12.
