- Technical Evaluation Criteria for Attorney Consultation Deliverables for Attorney Consultation Statement of Work for Attorney Consultation This is a Request for Quotation prepared in accordance with FAR Part 13. A quote is being requested and a written solicitation will not be issued. Requirement number 221-2-3086-01 is issued as a Request for Quotation. The Centers for Medicare and Medicaid Services (CMS) intends to award using Simplified Acquisition Procedures (limitation of $150,000), a fixed price purchase order at a fixed labor rate for an attorney to provide consultation services. The attorney shall be an expert in gerontology and legal issues in nursing homes, including regulatory and survey process issues. The attorney shall be familiar with the work of the Division of Nursing Homes (DNH) in developing the survey processes and the Interpretive Guidelines and surveyor training. A detailed Statement of Work is attached and a Schedule of Deliverables. A purchase order award will be made approximately (15) business days after the response due date of this notice. The period of performance will be for twelve months. The government estimates the level of effort for this requirement will be approximately 1176 professional person hours. The North American Classification System Code is 541110. This request for Quotes (RFQ) is being set aside for small business concerns. Questions regarding this requirement must be submitted in writing no later than November 17, 2011. Your response must be sent electronically in MS Word format to phillip.harrell@cms.hhs.gov or in paper no later than 12:00pm on November 23, 2011 to Phillip Harrell, Department of Health and Human Services, Centers for Medicare and Medicaid Services, Office of Acquisition and Grants Management, 7500 Security Blvd, Mailstop B3-27-35, Baltimore, MD 21244. Your response shall be no more than 12 pages and shall include the following: 1) Business Information: a. DUNS b. Company Name c. Company Address d. Type of Company (i.e small business, 8(a), woman owned, veteran owned, etc) as validated by the Central Contractor Registration or (CCR) 2) A brief overview of the contractor's capabilities and plans to perform the Statement of Work ; 3) Past performance information (relevant experience to perform the required services); and 4) Price of the deliverables (to include hourly rates). Your response will be evaluated on a best value basis using the following: 1) attached Technical evaluation criteria 2) Personnel 3) Past performance and 4) Price of the deliverables. The government intends to award an order to the responsible offeror whose quotation offers the best combination of technical capabilities and proposed price; the best value (considering price and other factors). All quotes/responses submitted shall remain valid for a period of 180 days. Offerors are advised that CMS is a secured facility and therefore, offerors should allow time to obtain the appropriate security clearances (e.g., parking pass, visitor badge, etc...) Vendors are also advised that the CMS mailroom accepts only U.S. Postal Service mail. When utilizing an overnight carrier, you are cautioned that you must allow time for the proposal to be delivered to the exact mail stop noted above by the carrier by the time specified in this RFQ. Interested parties must be able to affirm no conflicts of interest with parties involved in Medicare claims processing in light of the work indentified in the Statement of Work. In the event that the vendor/government identifies a conflict or the appearance of a conflict, the vendor shall be responsible for providing a mitigation strategy that satisfies the government. In the event that the conflict cannot be resolved, the order cannot be awarded or an existing order may need to be terminated.
