Description
This is a notice of intent to award a sole source contract and is not a request for competitive proposals. The government intends to solicit a proposal and enter into a contract with Environmental Conservation, Alaska Department of, to complete ADEC oversight. This notice of intent is not a request for competitive proposals. However, the Government shall consider all responses received prior to the close date of this announcement. Written responses to this notice shall contain sufficient documentation to establish bonafide capability to fulfill the requirement. A solicitation is not available. JUSTIFICATION FOR OTHER THAN FULL AND OPENCOMPETITION (or SOLE SOURCE) BACKGROUND: In accordance with a Memorandum of Agreement between the State of Alaska and the National Park Service (NPS) and the Bureau of Land Management (BLM) dated 2/2/05, the NPS and BLM shall reimburse the State (in this case the Alaska Department of Environmental Conservation) for timely and reasonable oversight of the agencies' management of contaminated sites in Alaska. 1) FAR Statutory Authority cited: 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. "The Alaska Department of Environmental Conservation (ADEC) is the only State regulatory agency in Alaska that provides oversight of contaminated sites. 2) Nature and description of the supplies or services required to meet the agency's needs: "ADEC shall provide regulatory oversight of the NPS contaminated sites in Alaska and bill the NPS on a quarterly basis according to the terms of the Memorandum of Agreement. Billing will be for oversight services that will occur over the from as soon as requisition is obligated to October 31st, 2011."Only ADEC provides regulatory oversight of contaminated sites in the State of Alaska."The cost of providing this oversight is based on previous year billings and is estimated at $30,500, which was projected by ADEC on 9/9/11. 3) A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): "Only ADEC provides regulatory oversight of contaminated sites in Alaska. 4) A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: "No market research was necessary. ADEC is the only State regulatory agency that provides this regulatory oversight. 5) Any other facts supporting the use of other than full and open competition: "None necessary. 6) A statement of the actions, if any, the agency may take to remove or overcome any barriers for competition before any subsequent acquisition for the supplies or services required: "None required.
