- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is W912EQ-12-Q-0005 and is being issued as a Request for Quote (RFQ). This procurement is 100% Set-Aside for Small Business Concerns. The associated NAICS code is 541199 with a size standard of $7.0M. All responsible sources may submit a quotation, which shall be considered by the agency. Quotes may be submitted in hard copy or electronically, either through regular mail, email, or by facsimile. Regardless of method of delivery, it is the offeror's responsibility to ensure receipt of quotes by the time and date stated herein. Contractors shall submit a lump sum quotation on company letterhead to include all charges for the following items to be delivered in accordance with the attached Performance Work Statement (PWS) and information below: Contractor shall furnish all supplies and services necessary to provide: 0001- Legal/Administrative Support Services at US Army Engineer District Memphis (Period of Performance: 31 October 2011-30 October 2012) 0002- Legal/Administrative Support Services at US Army Engineer District Memphis (Period of Performance: 31 October 2012-30 October 2013)-Option Year 1 The Contract will be for one (1) base year with one option for an additional year. Introduction The purpose of this Statement of Work (SOW) is to detail the tasks and responsibilities in relation to the following work. The Contractor shall provide legal and administrative support services in support of the US Army Corps of Engineers (USACE) Memphis District Operations Division. 2. Location All work shall be performed at USACE located in the Federal Building at 167 N. Main Street, Memphis, TN 38103. 3.Period of Performance Work shall commence on 31 October 2011 for a period of one year, with an option for an additional year. Work shall be completed between the hours of 8:00AM and 4:30PM CST. 4.Scope The Contractor shall provide the following services under this contract: a.Office Automation - Operates office automation equipment, including a local area network and personal computer utilizing modern applications, including multi-tasking operating environment, word processing, spreadsheet, legal calendar/docketing, electronic mail, and litigation-support and financial management software. Inputs and retrieves data and maintains numerous legal, financial, and other databases used in the office. Produces a variety of legal materials (e.g. correspondence, reports, studies, memoranda, etc.) using word processing software to enter, revise, sort, and retrieve data for standard reports. Subject matter includes legal terminology (e.g. Latin phrases, words not generally used by the general public, etc.) and, terminology specifically associated with construction, engineering, real estate, environmental matters, removal of hazardous waste, and operation of navigation and flood control projects. Incumbent is responsible for recognizing those words or phrases which require review for meaning and/or spelling. b.Clerical/ Administrative - Distributes and coordinates attorney work flow, picks up, reviews and distributes incoming correspondence, delivers outgoing correspondence to the mailroom,, arranges conferences and meetings, and prepares a wide variety of reports and legal documents. Receives and refers office visitors and phone calls and takes messages in accordance with established policies, procedures and regulations. Uses brief oral instructions concerning addresses and nature of correspondence to prepare letters requested. Performs research to obtain facts and evidence for use in the preparation of exhibits, cases, legal memoranda, pleadings, discovery, reports, agreements and legal correspondence. Follows general directions concerning the nature of the material required as well as the extent and depth of material. Utilizes legal databases, files, library, the Internet, knowledge of the Corps of Engineers organization and other sources to obtain necessary facts and information. Selects such information as is clearly covered by the requirements for evidence indicated by the attorney and determines those facts which are not clear cut, but which it is believed should included; eliminates nonessential or inapplicable data. Reproduces documents with a copy machine when requested c.Litigation Support - Searches case reports, legal documents, databases, periodicals and textbooks and prepares motions, interrogatories, briefs, Rule 4 assemblies, litigation reports, etc., working closely with other District elements in compiling data and obtaining required supporting documents, assembling the reports in proper format and composing transmittal letters to higher echelon. Makes arrangements, for location of hearings and trials and schedules court reporters. Makes arrangements for witness attendance at pre-trial conferences, hearings, and trials. Interviews potential witnesses, makes recommendations regarding selection and prepares the to give testimony. Enters and updates information on the Matter Tracking System d.Freedom of Information Act (FOIA) - Under the general supervision of the FOIA Officer, maintains the FOIA Register, including electronic log and databases. Schedules responses and follows up when schedule is not met. Prepares letters to implement the program. Compiles data for annual report. e.Labor and Employment. Performs various tasks associated with the District Labor and Employment Law program. Utilizes WestLaw and LEXIS/NEXIS Researches Title VII EEO laws, FLRA, MSPB and other Federal Statutes and Regulations, Federal, DoD, Army and USACE regulations. Assists the District Labor Counselor and District Counsel in preparing initial discovery responses and drafts for District Labor Counselor. Gathers information responsive to discovery requests. Prepares initial drafts of MSPB Agency files, EEO IRD investigation documents, and assists in gathering supporting documents for disciplinary actions. Schedules meetings with managers, supervisors and witnesses. Reserves conference rooms. Formats documents. Coordinates routing of documents for internal staffing review. Enters cases into the Matter Tracking System. Updates database as required. f.Legal Research - Conducts legal research and drafts legal opinions and other legal documents on all aspects of the District s mission as referred by the District Counsel or other attorney, contacts and consults with Federal, State and local officials or agencies (e.g. New York State Department of Environmental Conservation, Ohio Department of Natural resources, U.S. Environmental Protection Agency, U.S. Fish and Wildlife Service, Engineer Board on Contract Appeals, U.S. General Accounting Office, etc.) to obtain factual and procedural information necessary for rendering advice and opinions. Problems as to interpretation are referred to supervisor for advice and approval after extensive research has been performed. 5.Required Skills Contract employee shall have a valid state driver's license, specialized experience and knowledge commensurate with the required tasks to be performed as indicated above. The Government reserves the right to reject any contract employee who does not meet requirements as stated above and to remove any contract employee who fails to meet contract performance standards. 6.Basis for Award Award will be to the lowest priced, technically acceptable (LPTA) offeror. Offerors shall have specialized experience and knowledge commensurate with the tasks specified above. Contractors shall demonstrate technical capability by submitting documentation of three relevant projects completed within the last three years. Documentation shall include a description of services, dates performed, dollar amount, contract number, and point of contact for reference.
