DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 115 South 84th Street, Suite 101, Milwaukee, WI 53214 on behalf of the Jesse Brown VAMC located at 820 South Damen Avenue, Chicago, IL 60612. Purchase Request number: 537-12-1-107-0001. 2.Nature and/or Description of the Action Being Processed: Justification and Approval for Other than Full and Open Competition for a contract with Wolters Kluwer Health, Inc. for on-line subscription services for Jesse Brown VAMC. The GLAC proposes entering into a one year FFP contract with the service provider. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Technical Scope: subscription services or a web-based on-site only medical reference material. Period of Performance: 10/1/2011 - 09/30/2011 4.Statutory Authority Permitting Other than Full and Open Competition: 41 U.S.C. 253(c)(1), 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): UpToDate is the only clinical reference database that covers sixteen medical specialties and subspecialties for clinicians, students, and educators at the VA. It is complete in the following specialties: adult emergency medicine, adult primary care, internal medicine, allergy and immunology, cardiovascular medicine, endocrinology, diabetes, family practice, gastroenterology, hepatology, hematology, oncology, infectious diseases, nephrology, hypertension, neurology, obstetrics, gynecology, women's health, pediatrics, pulmonary, critical care, sleep medicine, and rheumatology. Over 4,500 leading physicians who function as authors, editors, and peer reviewers collectively write topic reviews that include a synthesis of the literature, the latest evidence, and specific recommendations for patient care. No other clinical database has access to this original content. UpToDate currently has over 9,000 unique topic reviews with 7,700 graded recommendations. The UpToDate community also includes the collaborative effort of over 400,000 users who provide feedback and questions to the editorial group. This community's combined efforts result in the most trusted, unbiased medical information available. Patient information is unique in that the material is evidence-based, regularly revised, state-of-the-art, written at two reading levels and concordant with the professional level material. Thus, patients and doctors can actively participate in shared decision making. UpToDate currently provides over 750 unique patient information topics. Many resources offer CME credit accrual but UpToDate has the distinction of being an accredited provider of point-of-care CME by the ACCME. Users are awarded ACCME Accredited AMA Category I CME for each search performed. There are no third party submissions, no additional fees and no testing required. UpToDate's CME is accredited by the following organizations, AMA, AAFP, AANP, AAPA, AAP, ACEP, ACOG, AOA & CFPC. UpToDate has been selected as an official educational program by eight leading medical societies in the United States including Society of Internal Medicine, The Endocrine Society, American College of Rheumatology, American Gastrointestinal Association, American Society of Nephrology, American Thoracic Society, and the American Academy of Family Physicians. These subscribers and societies recognize the high quality and value of UpToDate information. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: An intent to Sole Source was posted on fbo.gov on Sept 12th. No potential offerors responded indicating an interest in the work and providing a capability statement. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Jesse Brown VA has also had prior contracts for these services. The services being performed are commercial in that all hospitals can obtain membership. Thus, Wolters Kluwer offers these programs under a general list price. Prices have been verified against this list price. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The program office examined other competing information resources, including STAT!Ref, DISEASEDEX, FIRSTConsult, InfoRetriever, and DynaMed. None of these provided the same degree and breadth of synthesized knowledge or information dissemination application allowing for clinicians to provide better care. Additionally, the VA has expended time and funding in learning the use of this application. It is vested in maintaining standardization among the VISNs in retaining this type of medical research tool. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None.
