- Class Justification for Other than Full and Open Competition (JOFOC) The NRC requires contractor technical expertise to assist with the licensing and inspection program and activities for the fuel cycle facilities. The support activities to be performed by the Contractor under this contract include, but are not limited to, the following: acceptance reviews of Licensing Amendment Request (LARs), preparation of safety evaluation reports (SER), participation in site audits, support of Advisory Committee on Reactor Safeguards (ACRS) presentations, support of pre-application activities, and support for potential litigation or hearings. In addition, NMSS requires contractor support to provide access to experts with competencies, accrued knowledge, and highly specialized skills in the areas of, but not limited to; materials engineering, quality assurance, areas of structural and geotechnical engineering, electrical engineering, mechanical engineering, instrumentation and control, software engineering, quality assurance, materials testing, risk analysis, health physics (to include laboratory analysis), hydrology, and fire technology. This is a non-competitive procurement under FAR 6.302-3 (Class Justification for Other than Full and Open Competition attached). A cost-plus-fixed-fee type contract was suitable in this instance due to the uncertainty involved in contract performance that does not permit costs to be established with sufficient accuracy to use a Fixed Price type contract.
