- The U. S. Coast Guard is considering whether or not to set-aside an acquisition for HUBZone concerns, Service-Disabled Veteran-owned Small Business concerns (SDVOSB), or for Small Businesses. This is not a solicitation or offer. No contract or order will result from this announcement. Response by interested parties must be made by 10:00 am PT on October 25, 2011. The NAICS Code is 336611. The small business size standard is less than 1000 employees. The acquisition is for the Dry-Dock Repairs of the USCGC VISE (WLIC-75305) a 75 foot "B" Class Inland Construction Tender. The Minimum Depth of Water is 7 feet 7 inches, and the minimum Height Clearance is 32 feet. The repairs will take place at the contractor's facility. The performance period is anticipated to be from: March 21, 2012 through June 1, 2012. The geographic restriction for this Cutter is 400 nautical miles one-way (800 nautical miles round trip). No open water transit is authorized. The USCGC VISE is home ported at 600 8th Ave SE, St Petersburg, Florida 33701. In accordance with FAR 19.1305, if your firm is HUB Zone certified or a Service-Disabled Veteran-Owned Small Business and intends to submit an offer on this acquisition, please respond by email to Jack.E.Rodman@uscg.mil and include: (a) a positive statement of your intention to submit a bid for this solicitation as a prime contractor; (b) evidence of experience in work similar in type and scope to include contract numbers, project titles, dollar amounts, points of contact and telephone numbers; (c) past performance references with points of contact and telephone numbers. At least two references are requested, but more are desirable. Your response is required by October 25, 2011 at 10:00 am PT. Contractors are reminded that should this acquisition become a HUB Zone set-aside, FAR 52.219-3, Notice of Total HUB Zone Set-Aside will apply which requires that at least 50 percent of the cost of personnel for contract performance be spent for employees of the concern. Contractors are also reminded that should this acquisition become a Service-Disabled Veteran-Owned Small Business Set-Aside, FAR 52.219-27, Notice of Total Service-Disabled Veteran-Owned Small Business Set-Aside will apply which requires that at least 50 percent of the cost of personnel for contract performance be spent for employees of the concern. All of the above information must be submitted in sufficient detail for a decision to be made on a HUB Zone, Service disabled Veteran-Owned Small Business Set-Aside or Small Business Set-Aside. Failure to submit all information requested may result in an unrestricted acquisition. NOTICE FOR FILING AGENCY PROTESTS It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal forum with the Ombudsman. Interested parties who believe that Coast Guard procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester's concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e).
