NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Reference Number is F1M3E31168A002. The 628th Civil Engineering, Joint Base Charleston, SC, requires an auxiliary engine for a Caterpillar 320 C Excavator in order to operate a hydraulic cutter head. The 628th Contracting Squadron intends to make an award to Blanchard Machinery Company, 3151 Charleston Hwy, West Columbia, SC 29172-2723. Market research was performed and information gathered in determining this company to be the only source for this requirement. Additionally, a solicitation was posted on FBO on 10 September 2011 and resulted in no responses. In accordance with (IAW) FAR Part 6.302-1, the proposed contract action is for services for which the Government intends to solicit and negotiate with only one source. This notice of intent to award is not a request for competitive proposals; however responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for the sole source requirements as follows: Blanchard Machinery Company is the only company that can provide auxiliary engine for a Caterpillar 320 C Excavator in order to operate a hydraulic cutter head because of proprietary regulations with Catapillar. The following provisions and/or clauses apply to this acquisition. Offerors must comply with all instructions contained in: FAR 52.204-7, Central Contractor Registration FAR 52.222-50, Combat Trafficking in Persons FAR 52.232-1, Payments FAR 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration, FAR 52.233-4, Applicable Law for Breach of Contract Claim DFARS 252.204-7004, Central Contractor Registration (52.204-7) Alternate A, DFARS DFARS 252.225-7001, Buy American Act and Balance of Payments Program DFARS 252.225-7002, Qualifying Country Sources As Subcontractors DFARS 252.232-7003 Electronic Submission of Payment Requests and Receiving Reports (WAWF instructions provided at time of award) AFFARS 5352.223-9001, Health and Safety on Government Installations AFFARS 5352.242-9000, Contractor Access to Air Force Installations CLAUSES INCORPORATED BY FULL TEXT AFFARS 5352.201-9101, Ombudsman (APR 2010) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (d) The ombudsman has no authority to render a decision that binds the agency.
