Description
A. This contract is to purchase conduit sets that will support the Rocket System Launch Program (RSLP) meet its current mission requirements of providing Space Launch vehicles for satellite and research and development programs across all DOD activities. The conduit sets will upgrade the equipment to provide extended service life in excess 10 years and make the equipment universal for multiple organizations to use in any needed situation. The purchase will help support the Minuteman Missile weapon system during time of need. The purchase must be done through Icore International due to the proprietary data rights held for the specialized hardware required for this equipment. These items cannot be provided by another source without the purchase of the data rights from Icore International. The new source of supply would then be required have their product validated and approved for use on Nuclear Weapons related systems. This would cause delays in excess of 2 years and unnecessary expenses to the RSLP Program Office. Therefore, this acquisition is for performance of a highly specialized service. B. The Rocket System Launch Program (RSLP) Office estimates award to any other vendor would result in unacceptable delays in fulfilling the RSLP requirements (and/or) substantial duplication of cost to the government that is not expected to be recovered through competition. Delays in the procurement would severely impact this organizations capability to meet the projected customer launch schedule. The delays in procuring conduit sets immediately will add cost increases to the projected repair estimates for the in service equipment previously projected out for 5 years. C. The Rocket System Launch Program Office believes award to any other source would result in substantial duplication of costs to the Department of Defense previously expended to approve the items provided by Icore International that is not expected to be recovered through competition. D. The last attempt to obtain the conduit sets, Icore International was contacted 26 january 2011 by Rocket Systems Launch Program Manager. The vendor responded with a quote per set if a minimum of 5 sets are ordered. To compete, the requirement would require the purchase of proprietary data owned by Icore. This would increase the cost beyond the capability of this program office. E. Accordingly, Icore International is the only firm capable of providing the supplies and services without the government experiencing unacceptable delays in fulfilling repair capabilities for its aging fleet of Transporter Erector Sets. AUTHORITY: 10 U.S.C. 2304 (C)(1), JUSTIFICATION: SUPPLIES REQUIRED ARE FROM ONLY ONE OR A LIMITED NUMBER OF RESPONSIBLE SOURCE(S) AND NO OTHER TYPE OF SUPPLIES WILL SATISFY AGENCY REQUIREMENTS. THE PROPOSED CONTRACT ACTION IS FOR SUPPLIES AND SERVICES WHICH THE GOVERNMENT INTENDS TO SOLICIT AND NEGOTIATE WITH ONLY ONE, OR A LIMITED NUMBER OF SOURCES UNDER THE AUTHORITY OF FAR 6.301-1. INTERESTED PERSONS MAY IDENTIFY THEIR INTEREST AND CAPABILITY TO RESPOND TO THE REQUIREMENT OR SUBMIT PROPOSALS. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. HOWEVER, ALL PROPOSALS RECEIVED PRIOR TO THE CLOSING DATE ON THE SOLICITATION WILL BE CONSIDERED BY THE GOVERNMENT.
