Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, Service Area Office (SAO) East, Network Contracting Activity 8, Construction Team 3, VISN 8, VA Caribbean Healthcare System (VACHS-00672), San Juan, Puerto Rico. This document is a Justification for Other than Full and Open Competition for purchase request (PR) No. 672-11-4-530-0296. 2. Nature and/or Description of the Action Being Processed: This is a procurement to obtain construction services for the site preparation to Install Data Drops, Cable, and Power for the CIS/ARK Computer System . This requirement will be awarded as a firm-fixed-price sole source contract. 3. Description of Supplies/Services Required to Meet the Agency s Needs: This construction project is to provide all labor, materials, tools, equipment, and supervision necessary to install data jacks, serial cables, electrical outlets, and computer stations. This work is required to be able to install and activate the new VISN 8 CIS/ARK computer system which will collect all patient physiological measurements and transmit it over CPRS. The estimated cost of this requirement is $100,000 and $250,000. The period of performance for completion of the work is 120 calendar days after the notice to proceed. 4. Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. 5. Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Authorized by Statute under the authority of 38 U.S.C. 8127 and 8128 (Sections 502 and 503 of Public Law (P.L.) 109-461, December 22, 2006), FAR Part 6.302-5(b)(6) and VAAR 819.7007. Sole source awards to service-disabled veteran-owned small business concerns: (a) A contracting officer may award contracts to SDVOSB concerns on a sole source basis provided: (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) The requirement is synopsized in accordance with FAR part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with respect to performance; and (4) Award can be made at a fair and reasonable price. (b) The contracting officer s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. (c) When conducting a SDVOSB sole source acquisition, the contracting officer shall ensure businesses are registered and verified as eligible in the VIP database prior to making an award. In this situation, the anticipated award amount is less than $250,000.00. A special notice announcing the contract action will be posted in FEDBIZOPPS as require by FAR Part 5. A separate determination of the contractor s responsibility has been made in accordance with FAR Part 9. A sole source award is proposed pending negotiation of a fair and reasonable price Gema Contractor Services Corporation is a verified Service-Disabled Veteran-Owned Small Business (SDVOSB) approved to provide services under the authority stated in Public Law 109-461 for NAICS code 238210. Gema Contractor Services Corporation, Inc received their verification in March 2011, and is registered in VetBiz, as well as in the Central Contractor Registration (CCR). Gema Contractor Services Corporation successfully completed a project at this site to upgrade the air conditioning and ventilation systems. Firm completed the work within the allotted time without disruption of the activity s operations. Contractor showed a high degree of quality craftsmanship and professional project supervision and received an outstanding performance evaluation. The Contracting Officer (CO) is recommending a SDVOSB sole source to Gema Contractor Services Corporation, base on the information provided above. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: In accordance with Public Law 109461, Veterans First Contracting Program, the CO is authorized to sole source to a SDVOSB. While there are other contractors in Vetbiz.gov, a determination that only one SDVOSB concern is available to meet the requirement is not required per the authority cited in paragraph 5. This facility has developed a cadre of contractors willing to compete for VA business with efforts made to rotate sole source requirements. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated award amount for this requirement is between $100,000 and $250,000. Based upon past experience with this contractor, it is the Contracting Officer s determination that negotiations will result in a fair and reasonable price that that compares favorably with the Independent Government Estimate. Proposal analysis will be performed in accordance with FAR 15.404-1 to ensure that the final agreed-to price is fair and reasonable. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The Puerto Rico area has available a good number of SDVOSB construction firms with various capabilities. The VIP database was queried in accordance with VAAR 810.001, Market Research policy; however market research was not formally performed to make a selection for a sole source negotiation. Gema Contractor Services Corporation is listed in the VIP database as verified and active as well in the CCR. It is anticipated that reasonable pricing will be achieved by negotiating with this contractor. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Per authorities cited in paragraph 5, the Contracting Officer s determination whether to make a sole source award is a business decision wholly within the discretion of the Contracting Officer. The Contracting Officer has determined that a sole source award is in the best interest of the Government. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11. A Statement of Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services require: With continued growth in the SDVOSB program, we strive to set projects aside for competitive SDVOSB procurements. Any future SDVOSB sole source awards, in the best interest of the VA, will be rotated among other SDVOSBs determined to be responsible. 12.
