- Based on RFQ VA-69D-11-RQ-1678 entitled "Traumatic Brain Injury Research Study" for the Research and Development Section of the Edward Hines VA Hospital, Hines, IL," award has been made to JCE CL CONSULTING LTD at the total contract amount of $48,475.00 as a Sole Source Procurement. National Avenue, Milwaukee, WI 53295. 578-11-4-105-0301 2. Nature and/or Description of the Action Being Processed: Justification and approval for Other Than Full and Open Competition for a clinical research study with JCE Clinical Consulting. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Research and Development office at Edward Hines VA Hospital has a requirement for a specialist to provide coordination and training of research and clinical personnel in the data collection for a multisite research project, complex data collection and analysis, and assist in the conceptualization and preparation of scientific manuscripts. 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c)(1)). 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The following unique features are specific to JCE Clinical Consulting: JCE Clinical Consulting, Inc is a private consulting company specializing in traumatic brain injury research and clinical coordination. They will provide the clinical research coordination for a multi-site research project involved in the recruitment of VA and Non-VA subjects. JCE Clinical Consulting, Inc is a specialty consulting company working with individuals with neurological impairments secondary to brain injury or stroke and employs over 15 years of clinical expertise and research knowledge. JCE Clinical Consulting services include data collection and management, training of clinical and non-clinical personnel, data analysis and manuscript preparation. Based on a review of similar providers, no other company was identified to have the expertise and experience in the area specific to this research project. JCE Clinical Consulting, Inc familiarity of the project would conclude to be the most appropriate company to perform the work. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The contracting officer called and emailed the companies on SBA and Vetbiz but none had the capability to perform. Other vendor's were evaluated but did not have all the required features. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: There are prior awards for this on FBO with what appear to be similar research projects with somewhat different approaches and requirements for similar costs. The requesting medical facility personnel who are experts in their field feel this is an appropriate amount for the needed research. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A search of SBA, Vetbiz and GSA was conducted and a company was not able to be found that was able to meet the requirements of the VA. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Nothing on GSA, VA NAC, VETBIZ, SBA. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None. 12. I posted VA-69D-11-RQ-0348 as a sole source to Technical Communities/DBA Testmart. MD Medical submitted a compatability statement offering the same exact item and I requested a quote from them. 2. My technical expert determined that both companies were offering the same items. When comparing the quotes both companies offered the same exact items at the same exact dollar amount. 3. I contacted the manufacturer to verify both companies were authorized to sell to the government and Lumenis stated they were. I sent out 2 different requests for best and final offers (BAFO) as lowest priced technically acceptable. Round one both came back with the original quote and refused to lower their quote. I waited a week and conducted the 2nd round of BAFO (28 April 2011) MD Medical still refused to lower their quote but Technical Communities/DBA Testmart lowered their quote by $1,000. I Awarded to Testmart 28 April 2011. 4. Notice of non-award will be sent to the following on 28 April 2011 stating award at $167,299.10 to Technical Communities/DBA Testmart. A. Miller and Dickey (MD) Medical, $168,299.10. 5. It is my decision to award to Technical Communities/DBA Testmart. 6. A GSA Waiver was not required for this acquisition. 7.
