Description
Naval Air Systems Command (NAVAIR) Naval Air Warfare Center, Aircraft Division (NAWCAD) Lakehurst intends to enter into a sole source delivery order with AAI Corporation (AAI) for the procurement of Repair of Repairables (ROR) and engineering services for the Organizational-level Electronic Warfare Test Program Set (OEWTPS) in support of the CV-22 Aircraft. The OEWTPS is needed to perform a suite of tests, including Electronic Warfare (EW) and Radio Frequency/Microwave and Avionics Systems, on the AN/USM-670 Joint Service Electronic Combat Systems Tester (JSECST). This effort will include tear-down, test and evaluation tasking, technical assistance, software sustainment, and data. The Navy does not own sufficient specifications, drawings, and related data for the OEWTPS to permit full and open competition. The Government possesses Level 2 drawings for the OEWTPS, which are not sufficiently detailed to permit any vendor other than the Original Equipment Manufacturer (OEM) to manufacture the OEWTPS. The Government does not currently own, nor does it anticipate procuring, a data package that is sufficiently detailed to allow potential sources to provide the repair and technical services required and thereby support competition for this effort. AAI is OEM of the OEWTPS and remains the only business entity that has all the required proprietary rights that are necessary to design, develop, and manufacture this V-22 Peculiar Support Equipment (PSE). The Government intends to procure this equipment under the authority of 10 USC 2304 (c) (1) as implemented by the Federal Acquisition Regulations (FAR) Section 6.302-1. All responsible sources may submit a response which may be considered by the Government in determining whether to conduct a competitive procurement. THIS IS NOT A REQUEST FOR PROPOSALS. A determination by the Government not to open the requirement to competition based on the responses to this notice is solely within the discretion of the Government. Information provided herein is subject to change and in no way binds the Government to solicit for an award of a contract. See numbered notes 22.
