Description
The Bureau of Reclamation, Yakima Field Office intends to negotiate sole-source contract with Coast Crane / Pasco for the repair of an 18 Ton National Crane. A Justification for Other than Full and Open Competition has been prepared in support of this intent under the authority of FAR Part 6. 302-1 (1) When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by- (i) Unique supplies or services available from only one source or only one supplier with unique capabilities; The cited authority must be used because only the proposed contractor possesses the following unique qualifications which are required for this acquisition: Proper care, maintenance, servicing and repair of cranes by trained personnel is of prime importance in assuring the proper operation of the unit. It is essential that the recommendations of the crane manufacturer recommended whenever a crane is serviced. Use of manufacturer recommended replacement parts is vitally important to avoid compromising the crane's performance, reliability, warranty and certification. Use of non-OEM or "non-complying replacement parts" (i.e., parts not authorized by the crane manufacturer or not in compliance with established requirements, specifications and quality standards) can result in equipment malfunction which can result in a potentially unsafe workplace situation and liability exposure for the part manufacturer, the servicing dealer and his customer. Use of unauthorized replacement parts by a dealer can void the warranty on a crane and put a customer and other parties in a position of being responsible for an' authorized alteration to the crane.COMPLIANCE WITH OSHA OSHA regulations applicable to employers in the construction industry state that the "employer shall comply with the manufacturer's specifications and limitations applicable to the operation of any and all cranes and derricks." The regulations further caution that "no modification or additions which affect the capacity or safe operation of the equipment shall be made by the employer without the manufacturer's written approval." (29 CFR 1926.550(a). The use of non-complying replacement parts on a crane may put the construction employer who uses that crane in violation of OSHA'S safety standards for the construction industry. Violation of OSHA standards can result in substantial fines and other penalties.NON-AUTHORIZED REPAIRS AND MODIFICATION Crane repair and modifications that are not authorized by the crane manufacturer may result in the same liability risks and warranty problems that flow from the use of non-complying replacement parts. OSHA regulations prohibit modifications or additions which affect the capacity or safe operation of a crane unless the crane manufacturer's written approval has been obtained. Non-authorized repairs and modifications may compromise the original equipment design as well as have a detrimental affect on performance. Firms believing they can provide the service must provide written notification to the Contracting Officer with supporting evidence to that effect in sufficient detail to demonstrate the respondent's ability to meet the stated requirements by close of business Friday, September 2, 2011. This notice is not a request for competitive quotations and award of this requirement will not be delayed to qualify a new contractor. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement for future acquisitions of this type.
