- JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. The Department of Veterans Affairs (VA), Veterans Benefits Administration (VBA) New York Regional Office, Service Center Division, executes this Justification and Approval (J&A) for Other Than Full and Open Competition. 2. Nature/Description of Action. This justification and approval (J&A) sets forth the facts supporting procurement of systems furniture on a limited sources basis for the New York Regional Office (NYRO), New York, NY, from JPL & Associates, LLC, 150 Pelican Point Drive #BA151, Sarasota, FL. The vendor is on a GSA Schedule, GSA Number GS-29F-008U. The intent of the procurement is to award to JPL & Associates, LLC as a logical follow on contract. 3. Description of Supplies/Services. The proposed total contract cost for the one Base year: $92,112.57.00. 4. Identification of Statutory Authority. The statutory exception permitting other than full and open competition for this acquisition is "Authorized or Required by Statute" as implemented by FAR 6.302-5. The applicable statute is Public Law109-461, Veterans First Contracting Program. 5. Demonstration of Contractor's Unique Qualifications. The New York Regional Office is limiting competition and intends to award the contract to JPL & Associates, LLC. based on the following: This is a logical follow-on acquisition of a major furniture procurement that was previously competed using Federal Supply Schedule ordering procedures. The previous Purchase Orders were VA306P00171 and 306P00205. VBA's nationwide hiring initiative and particularly New York RO hiring influx and the need for mandatory overtime by Service Center employees precipitated the need for additional ergonomically dynamic chairs. Without use of a limited source procurement strategy for the Herman Miller Aeron chairs to accommodate the new employees and longer workdays, unacceptable delays are most certain and would substantially impact providing timely services to the Veteran population. Obtaining additional procurement of Herman Miller Aeron chairs from JPL & Associates, LLC is necessary to match the same specific cubicle configuration (i.e., unique surface configuration, specific storage units, other), the same color scheme as well as providing office furniture uniformity throughout the New York Regional Office. These also allow flexibility to quickly and economically address future reconfiguration of office spaces that continue to be a constant requirement for a growing NYRO. It is in the best interest of the Government to keep uniformity and consistency throughout the NYRO from the same source reducing costs and delays due to mismatches in workstation types that would need be to be addressed on every relocation and/or office reconfiguration. Continued use of Herman Miller furniture will ensure that a single manufacturer is responsible for quick and timely replacement of damaged or worn parts as well as fulfillment of Herman Miller's warranty commitment. 6. Description of efforts made to ensure offers are solicited from as many potential sources as practicable. New York RO has determined that the time-sensitive nature of the requirement including furniture test fits from multiple vendors will seriously impact the reporting of new personnel onsite. Due to the recent procurement action and the need to maintain continuity of furniture at the New York RO for the reasons stated above, no additional market research was conducted. 7. Determination of Fair and Reasonable Prices. The order represents best value in terms of price and delivery schedule. GSA has negotiated the schedule prices and the New York Regional Office determined price reasonableness in comparison with previous acquisitions. 8. Description of Market Survey. New York Regional Office has determined that the time-sensitive nature of the requirement including furniture test fits from multiple vendors will seriously impact the reporting of new personnel onsite. Due to the recent procurement action and the need to maintain continuity of furniture at the New York Regional Office for the reasons stated above, no additional market research was conducted. 9.Other facts supporting the use of other than full and open competition.
