Description
Sources are being sought under NAICS 324110 for Fuel Tender(s) services (non-aviation) for use on a potential local, Regional, and/or Nationwide basis. Note that historically Fuel Tender(s) solicitations have been issued using NAICS 484220 for 'Specialized Freight (Except Used Goods)'. The SBA Office of Size Standards has since been asked to provide an opinion on the appropriate NAICS code for Fuel Tender(s). Because the primary purpose of the commercially provided fuel tender is to provide fuel, the nonmanufacturer rule applies as follows: 'For Federal government contracts, a concern that supplies a product it did not manufacture is termed a nonmanufacturer. To qualify for Federal government contracting, a nonmanufacturer must have 500 or fewer employees, be primarily in the wholesale or retail trade, and supply the product of a US small manufacturer, if the contract is set aside for a small business.' The USDA Forest Service is interested in ascertaining whether, utilizing NAICS 324110 and the nonmanufacturer rule, a sufficient number of small businesses are available to provide Fuel Tender(s) services for fire suppression and all-hazard incidents, Fuel Tenders may be used on mountainous roads with gravel or native surfaces, narrow, unimproved roads, off roads, in mountainous, rangeland and timbered areas, and may be operated where there is brush and trees growing on the shoulders. A contractor supplied Fuel Tender operator has the final say on where and how the vehicle can be used. Equipment shall meet all standards established by specification or incorporated by reference and shall be maintained in good repair by the contractor. Fuel Tender Types include: Type 1 (3501+ gallons); Type 2 (2501 - 3500 gallons); and Type 3 (500-2500 gallons). Fuel Tender Equipment Requirements: shall be fully registered as a commercial vehicle and be current with all DOT, EPA and state inspection requirements; shall provide a qualified operator for each shift ordered; fuel tender dispensing system shall have a separate dispensing system for each product offered and provide both diesel and unleaded fuel; shall contain a certified meter to measure accurate deliveries; spill containment kits that are applicable to mobile fuel dispensing vehicles must meet state and federal hazardous materials containment requirements. Contractors shall be able to accept all major credit cards for payment of fuel and providing receipts for sales at the incident. Sources interested are requested to submit their request no later than 12PM (MST) 24 Aug 2011. Sources shall include in their requests, a point of contact with phone and e-mail information, business size status under NAICS 324110, and information pertaining to their experience in providing services either the same or similar to those identified in this notice. This notice is for information and planning purposes only and is NOT a solicitation. Respondents are advised that the Forest Service is under no obligation to acknowledge receipt of information or provide feedback to respondents with respect to any information submitted.
