- United States Department of the InteriorNATIONAL PARK SERVICEYELLOWSTONE NATIONAL PARKPO Box 168Yellowstone National Park, Wyoming 82190 Justification for Brand Name Products Date:08-15-2011Project:Detroit Diesel Parts 8V92 1.Identifications a.Agency:National Park Serviceb.Contracting Office:Yellowstone National Park 2.Description of the action being approved:The National Park Service (NPS) shall be soliciting for 8V92 engine overhaul engine parts. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR). 3.Description of supplies and services: ProductEstimated price8V92 engine overhaul kits$9,000.000 4.Authority:a.41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.b.FAR Part 11.105: The Brand Name products are essential to the Government's requirements, and market research indicates other companies' similar products do not meet and cannot be modified to meet the agency's needs.c.FAR 6.302-1: The use of the name brand products are essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. 5.The description of the product's unique qualifications or the unique nature of the acquisition: Due to the expense and labor hours required to rebuild an 8V92 Detroit engine Yellowstone National Park is requesting original equipment replacement parts. OEM parts outperform and out last aftermarket parts. The 8V92 engines are used in snow removal equipment during winter operations and the reliability of these engines is critical to the operation. 6.Efforts to obtain competition: a.Efforts to ensure offers are solicited from as many potential sources as is practicable:For acquisitions over $25,000 the solicitation will be issued on the Government's Point of Entry, FedBizOpps.gov. b.Presolicitation notice per FAR 5.2:For acquisitions over $25,000 a presolicitation notice shall be posted on the Government's Point of Entry, FedBizOpps.gov unless the exception noted at FAR Part 5.202(a)(13) applies. 7.Determination that costs will be fair & reasonable: Describe how the Government will verify the price for the product is fair and reasonable. YNP Vehicle Maintenance Management has done Market Research to determine the price of OEM parts to be fair and reasonable compared to aftermarket parts. The price difference is offset by the increased reliability of OEM parts. 8.Description of the market research conducted: Yellowstone National Park Vehicle Maintenance has used internet research, vendors and OEM distributors to conduct market research to determine fair and reasonable pricing. 9.Other facts supporting other than full & open competition: a.Reason why documents suitable for full & open competition have not been developed: OEM parts outperform and have tighter manufacturing tolerances than aftermarket parts. OEM manufactures have original manufacturing specification and parts are not reverse engineered. b.Data, estimated costs or other rationale as to the extent or harm to the Government: Using other than OEM parts will cost the Government in vehicle down time, shop time, mechanic labor, and the cost of parts replacement. 10.Interested Sources: Interstate Power Systems. Billings MontanaSmith Diesel Salt Lake City Utah 11.Actions to remove barriers to competition in the future for similar acquisitions: YNP Vehicle Maintenance will always ask for OEM parts when engine rebuilding is in question.
