- The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Chesapeake Mission Critical, LLC, of Beltsville, Maryland for the purchase of an upgrade (consisting of dual zigzag harmonic reduction transformers) for UPS Systems under other than full and open competition by the authority of FAR subpart 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements. NIST currently utilizes Uninterrupted Power Supply (UPS) units supplied by Chesapeake Mission Critical, LLC. in several of its buildings. The purchase of these UPS units was competed under full and open competition in 2010 (contract SB1341-10-SE-0497). At the time of award dual zigzag transformers were not available for purchase, so they were not included. However, now that this upgrade is available, NIST has determined that it is advantageous to add this upgrade to its UPS units going forward for several reasons, as these transformers: 1. cancel the third, fifth, and seventh harmonics output current; 2. limit current distortion on the input side of the transformer, preventing thermal stress on conductors; 3. neutral conductor allows for high harmonic thus canceling the harmonic distortion to travel from output to input. These dual zigzag transformers will be the new NIST standard for all UPS system input to output transformers, and all UPS replacements going forward will have this requirement. As Chesapeake Mission Critical will be supplying the UPS units under contract SB1341-10-SE-0497, and it must integrate the appropriate dual zigzag transformers at its facility before delivery to NIST, Chesapeake Mission Critical is uniquely qualified to provide and install the required dual zigzag transformer components. Allowing an outside vendor to install components on UPS equipment provided by Chesapeake Mission Critical will void CMC's warranty on this equipment. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor's commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 334419, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on August 30, 2010. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
