- NASA/KSC has a requirement for Merge Plugin Software Assurance for Floating License, Qty5 each. Merge Plugin Software Assurance for Floating License, Qty 10 each. MagicDraw UMLSoftware Assurance for Teamwork Server, over 10 connections, Qty 1 each. MagicDraw UMLSoftware Assurance for Enterprise Edition Floating License, Qty 24 each. Cameo DataHubSoftware Assurance for Seat License, Qty 10 each. NASA/KSC intends to purchase the items from No Magic, Inc. Pursuant to FAR13.106-1(b)(1) the circumstances of the contract action deem only one source reasonablyavailable.The Government intends to acquire a commercial item using FAR Part 12.Interested organizations may submit their capabilities and qualifications to perform theeffort in writing to the identified point of contact not later than 4:30 p.m. local timeon August 29, 2011. Such capabilities/qualifications will be evaluated solely for thepurpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and opencompetition basis, based upon responses to this notice, is solely within the discretionof the government.Oral communications are not acceptable in response to this notice.All responsible sources may submit an offer which shall be considered by the agency. NASA 1852.215-84 Ombudsman. (OCT 2003) (a) An ombudsman has been appointed to hear and facilitate the resolution of concernsfrom offerors, potential offerors, and contractors during the preaward and postawardphases of this acquisition. When requested, the ombudsman will maintain strictconfidentiality as to the source of the concern. The existence of the ombudsman is not todiminish the authority of the contracting officer, the Source Evaluation Board, or theselection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of formal contract disputes.Therefore, before consulting with an ombudsman, interested parties must first addresstheir concerns, issues, disagreements, and/or recommendations to the contracting officerfor resolution.(b) If resolution cannot be made by the contracting officer, interested parties maycontact the installation ombudsman, the current list of Center Ombudsmen is available athttp://prod.nais.nasa.gov/pub/pub_library/Omb.html. Concerns, issues, disagreements, andrecommendations which cannot be resolved at the installation may be referred to the NASAombudsman, the Director of the Contract Management Division, at 202-358-0445, facsimile202-358-3083, e-mail james.a.balinskas@nasa.gov.
