- DEPARTMENT OF VETERANS AFFAIRS Sole Source Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 05, Martinsburg, West Virginia VA Medical Center. A sole source justification for other than full and open competition for training. Purchase request number 613-11-3-521-0038 (Human Resource Management Training). 2.Nature and/or Description of the Action Being Processed: Martinsburg is seeking concurrent /continuation of training from Grant Group, a Service Disabled Veteran Owned Small Business (SDVOSB), found on the GSA schedule (GS-10F-0120T). The previous contractual obligation has expired therefore the new procurement will set out a new contractual agreement based on fixed prices on the GSA schedule. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Martinsburg Human Resource Management Department has identified the need to conduct the final session of "The Essential of Human Resource" training, a site visit with Fiscal Service Leadership to review the existing Performance Management Process that will lead to three one day programs on Performance Management for Supervisors, derived from content and information gained from the Fiscal site visit. The Essential of Human Resource training will be provided to 30 personnel at $325 a person for a total of $9750.00, the off site visit will cost $3,000.00, and the Performance Management for Supervisors will be provided to 150 personnel at $225.00 a person for a total of $33,753 and grand total of $46,500.00 training dates will be identified upon award. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c), as implemented by FAR 6.302. (XX) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Grant Group has provided human resource training to the VA across VISN's as documented by past performance research. The Grant Group has tailored their human resource training to the unique needs of The Veteran Affairs (VA) Human Resource Departments and offers that training in incremental sessions. Considering the continuity and progressive nature of the training, it is in the VA's best interest to maintain that continuity and progressive learning approach. Severing the continuity of past training objective will jeopardize the facilitation of learning. The Grant Group has provided the first two session of training to the Martinsburg Human Resource Department (MHRD) and now the MHRD is requesting the third and final session to complete the training cycle. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: N/A 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Price and cost reasonableness is based of GSA schedule pricing and past procurement cost. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was conducted and several vendors are found to provide human resource training, however, the Grant Group's unique training style and approach could not be mirrored to maintain continuity of learning objectives, progressive learning, and the facilitation of overall learning. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Human Resources would like to continue with the aggressive training approach, syllabus and curriculum initiated with Grant Group. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Martinsburg fully understands that after the completion of this procurement for training that any further need for human resource training will require a new contract competed through full and open competitive means. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
