Description
THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN SUBPART 12.6, AND THE TEST PROGRAM OUTLINED IN FAR 13.5, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT IS THE ONLY SOLICITATION; REFERENCES ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. THE SOLICITATION NUMBER IS E11PCW0009 AND IS BEING ISSUED UNDER FAR PART 13 AS A REQUEST FOR PROPOSAL. THIS IS A 100% SMALL BUSINESS SET-ASIDE. THE NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) FOR THIS PROCUREMENT IS 541990. THE AWARD WILL BE A LABOR HOUR CONTRACT FOR ONE BASE PERIOD (12 MONTHS) AND ONE OPTION PERIOD (12 MONTHS). THE CONTRACTOR SHALL PROVIDE ALL THE MATERIALS AND LABOR FOR THE REQUIRED SERVICES IN THE ATTACHED STATEMENT OF WORK. PLACE OF PERFORMANCE SHALL BE THE OFFICES OF THE NATIONAL NAGPRA PROGRAM, 1201 EYE STREET, NW, WASHINGTON, D.C. THE FOLLOWING FAR PROVISIONS AND CLAUSES ARE APPLICABLE TO THIS ACQUISITION: FAR 52.212-01, INSTRUCTIONS TO OFFERORS-COMMERICIAL ITEMS, FAR 52.212-2, EVALUATION - COMMERCIAL ITEMS; FAR 212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS - COMMERICAL ITEMS. OFFERORS SHALL PROVIDE A COMPLETED COPY WITH ITS SUBMISSION; FAR 212-4, CONTRACT TERMS AND CONDITIONS - COMMERICAL ITEMS; FAR 52-212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUES OR EXECUTIVE ORDERS - COMMERCIAL ITEMS, FAR 232-18, AVAILABILITY OF FUNDS, FAR 217-9, PAYMENT BY ELECTRONIC FUNDS TRANSFER - CENTRAL CONTRACTOR REGISTRATION; 52.216-21, REQUIREMENTS; 52.217-5, EVALUATION OF OPTIONS. THE FOLLOWING FACTORS SHALL BE USED TO EVALUATE OFFERS: 1) TECHNICAL CAPABILITY, 2) PAST PERFORMANCE; AND 3) PRICE. AS PAST PERFORMANCE, THE OFFEROR SHALL SUBMIT REFERENCES FROM THE PAST 3 YEARS FOR SIMILAR OR LIKE CONTRACTS INCLUDING POC, TELEPHONE NUMBER, CONTRACT NUMBER, CONTRACT VALUE, PERIOD OF PERFORMANCE. AS PART OF ITS TECHNICAL PROPOSAL, THE OFFEROR SHALL DESCRIBE ITS APPROACH TO THE STATEMENT OF WORK, AS WELL AS ANY APPLICABLE EXPERIENCE WITH SIMILAR REQUIREMENTS. STATEMENT OF WORKNAGPRA Civil Penalty Investigator Background The service to be provided involves preparation for the investigation of museums that have allegedly failed to comply with the requirements of the Native American Graves Protection and Repatriation Act (NAGPRA), and some investigation of these museums under direction of the Solicitor pursuant to the rule on civil penalties at 43 C.F.R. 10.12. The candidate will work directly with the National NAGPRA civil penalty coordinator, who is a full-time NPS employee. The civil penalty coordinator receives the work product of the investigator and staffs the Assistant Secretary for Fish and Wildlife and Parks, who has been delegated the NAGPRA civil enforcement function. Together, the civil penalty coordinator and investigator work closely with the Office of the Solicitor's Division of Parks and Wildlife. The National NAGPRA Program maintains a wall between the Department's NAGPRA civil enforcement function and the National NAGPRA Program's technical assistance function. Scope There are three parts to the scope of work:a.Organizing allegations of museum failure to comply. The candidate will review all the written allegations received from 1997 to date and, for each allegation, identify which of the nine possible counts of museum failure to comply were alleged. Each allegation will be given an identifier in order to track the allegation as it proceeds through the investigation and civil penalty process toward resolution. The candidate will work with the civil penalty coordinator to determine the arrangement of files for entry into the National NAGPRA Program electronic data system, and will enter data into the system. In addition, the candidate will produce a spread sheet of open cases that will identify the museum, counts alleged, year alleged, and status of the matter (open/under active investigation/under review and issuance at the Department/closed), and will annotate the nature of the allegation based on the enumerated failures listed in the NAGPRA regulations at 43 C.F.R. 10.12. b.Investigating alleged museum failure to comply with the requirements of NAGPRA. Working with the NAGPRA civil penalty coordinator, who will identify allegations and counts for active investigation, the investigator will seek to verify facts in the allegations pertinent to a failure to comply. This work will require the candidate to review the National NAGPRA Program's files and databases for the existence of compliance documents, interview the museums that are the subject of the investigations, and occasionally follow up with the party or parties alleging the failure to comply. Contacts with museums may be by phone, email and, on occasion, in person. Some travel may be required. Travel costs will be reimbursed by the National NAGPRA program and will not be part of the costs in this contract. The National NAGPRA civil penalty coordinator will prioritize the investigations, based on the report of the status of the allegations in the files compiled by the investigator.c.Calculating the proposed civil penalty amount when the Assistant Secretary has determined that the museum has failed to comply on one or more counts. If, during the period of this contract, the Assistant Secretary determines that a museum has failed to comply with the requirements of NAGPRA, and proposes to assess a civil penalty, the investigator will compile the penalty assessment, applying the National NAGPRA Program's penalty calculation guide, the requirements of 43 C.F.R. 10.12, and the facts of the case as determined by the civil penalty coordinator. Selection criteria--The contractor must have good language and writing skills. --The contractor must keep a calm and impartial disposition at all times. The contractor must remain a neutral in investigations, never acting as an advocate for the museum or the entity bringing the allegation. -Knowledge of the NAGPRA process and practical application of the law to museums is highly desired. Candidates with demonstrated experience in an aspect of the NAGPRA process are preferred. Knowledge of museum records and the manner of listing human remains and items in museum collection is helpful. --Civil penalties are substantiated on demonstrated facts and the contractor must have some experience in fact collection and assessments as an investigator, attorney or other related research position. --Good organization skills are critical to the tasks described above. Documents must be organized for information retrieval with no loss of information or documents. Attention to detail in data entry is also critical. --The contractor must possess basic computer skills for making charts and lists and data entry into a pre-established database. --Civil penalty investigation requires acting on information from the public, which can result in fines paid by a museum. The integrity of the process must be maintained in each aspect of the duties described above. The contractor must keep all documents and information gained within the confines of the National NAGPRA Program and defer all release of information to the Solicitor or NAGPRA Civil Penalty coordinator. The contractor must act in accordance with Department policy and ethics requirements. --The contractor must have access to the National NAGPRA Program offices in Washington, DC. Travel to perform non-investigative contract functions will not be compensated. The contractor must be able to successfully complete a background security check to enable access to the program databases. The contractor must be able to travel locally on occasion to complete investigations as directed. Deliverables or delivery schedule The initial deliverable, constituting the bulk of the tasks in the beginning phase of the contract, is the production of organized files and a list of open allegations organized by type, date and other pertinent data as indicated by the Civil Penalties Coordinator. That list will be entered on the internal National NAGPRA Program database by the contractor. The contractor will then produce reports and charts from the data entered to further assist in case management and provide program reports for the public as directed. Investigation of cases, upon case-by-case direction will require examination of National NAGPRA Program files to provide substantiation of allegations with demonstrated facts. Deliverables will consist of short factual reports utilizing a standard reporting format provided by the National NAGPRA Program. In those cases where travel to a museum is required, the deliverable will include obtaining factual information from museum officials and their files, for inclusion in the investigative report. Follow-up investigations of penalty calculations may require telephone calls to affected tribes, using a set criteria for penalty calculation. Reports of penalty assessment determinations will also be completed using a form provided by the program. Government-furnished equipment and Government-furnished information The government will furnish the civil penalty files at the offices of the National NAGPRA Program, as well as a work space and computer. The files and information remain the property of the Federal government and all information is subject to government information retention standards. SecurityHSPD 12 clearance is required if contractor onsite greater than 120 days or has access to government systems. The National NAGPRA Program will cover the cost of obtaining security clearance and will work with the contractor to obtain security access to the worksite. The contractor is responsible for abiding by all security requirements and taking the necessary training for document and information protection. Place of performanceThe place of performance shall be the offices of the National NAGPRA Program, 1201 Eye St. NW, Washington, DC, or successor space for the program in Washington, DC. Some travel may be required, of a few days at a time and not more than an aggregate of one month in the option years. Period of Performance: Base Period: Aug. 25, 2011 - August 24, 2012Option Year 1: August 25, 2012 - August 24, 2013 Approximately 600 hours is estimated, but not guaranteed, during the base year. The total value of this contract including the base year and option year is not expected to exceed $100,000.00.
