This proposed contract action is used for MOR Restock Plates & Screws for Orthopedics Department. The Naval Medical Center San Diego intends to solicit with only one source under the authority of FAR 13.106-1(b). The source is Depuy Mitek Inc. CAGE Code: 0J723, NAICS: 339112. Justification: As required by FAR 13.106-1(b), the Contracting Officer has determined that Depuy Mitek Inc. is the sole manufacturer and Distributor for their products. Depuy is tricare standard and many of their products are unique and made to work with instrumentation that Orthopedics Department already owns. IAW FAR 5.207(c) (15) (ii), all responsible sources may submit a quotation, which shall be considered by the agency. The Government will only consider firm, fixed price quotations. The attached solicitation document and incorporated provisions and clauses are those in effect through FAC 2005-52. It is the contractor 冱 responsibility to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at www.acquisition.gov and/ or www.acq.osd.mil.
