- The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b) (1), with A.S. Scientific, Abingdon Science Park, Oxfordshire, GBR for a five-year Blanket Purchase Agreement (BPA) for the repairs of unique cryostats originally manufactured by the Institut Laue Langevin (ILL). Sole source determination is based on the need for emergent repairs to existing cryostats on an "as-needed" basis. The cryostats owned by NIST were made by A.S. Scientific or by the Institut Laue Langevin (ILL). The ILL no longer sells the cryostats, and A.S. Scientific sells and repairs them under a license agreement with the ILL. This BPA is intended for use in circumstances where repairs require custom parts, when off-the-shelf replacement products do not exist. These custom parts are proprietary to A.S. Scientific. The BPA is also intended for use when repairs are deemed sufficiently complex or difficult as to be beyond the expertise of NIST personnel. In this situation, the only repair shop that can reasonably be expected to have the knowledge and experience necessary is the original manufacturer, A.S. Scientific. As a result, A.S. Scientific is uniquely qualified to provide the required repairs. Delivery shall be FOB Destination and be completed in accordance with the Contactor's commercial schedule. As defined in the federal Acquisition Regulation (FAR), FOB Destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at delivery point specified in the purchase order, and pay all charges to the specified point of delivery. The contractor shall deliver all line items to NIST, Gaithersburg, Maryland, 20899-0001. The North American Industrial Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 Employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the government will consider responses received by August 12, 2011. A determination by the Government not to compete the proposal acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
