- The purpose of this amendment is as follows: 1. Amend the anticipated release date of the solicitation to on or about 5 August 2011. 2. Please note attachments to this solicitation contain limited distribution markings which will need to be requested by potential offerors. In order to be eligible to receive these documents offerors must complete and submit required documentation. Below is the excerpt from Section A of the solicitation detailing the process to obtain these documents. It is requested that potential offerors submit the below documentation for processing prior to solicitation release. 3. Potential offerors may request blank forms from Nadine Schneider at following email address nadine.schneider@us.army.mil 4. Excerpt from Section A is as follows: REQUEST FOR TECHNICAL MANUAL, MUNITION CONTROL UNIT MAINTENANCE INSTRUCTION AND REMOTE CONTROL UNIT CLONING GUIDE Request of Technical Manual TM 9-1230-781-13&P, Munition Control Unit Maintenance Instruction and Remote Control Unit Cloning Guide. This requirement is for Spider XM-7 CLS. The associated Technical Manual, Munition Control Unit Maintenance Instruction and Remote Control Unit Cloning Guide listed in Section J as an attachment, will be provided upon request. Note: The highest Distribution Level is Distribution D for this procurement. Attachments identified in Section J reflect the appropriate markings, which limit dissemination only as directed by the Office of the Project Manager for Close Combat Systems, ATTN: SFAE-AMO-CCS, Picatinny Arsenal, NJ 07806-5000. Distribution D: Distribution Authorized to the Department of Defense and U.S. DoD Contractors only critical technology. Other requests shall be referred to the Office of the Project Manager for Close Combat Systems. ATTN: SFAE-AMO-CCS, Picatinny, NJ 07806-5000. This determination was made on 1 April 2008. Export of this technical manual is restricted by the Arms Export Control Act of 1979, as amended, Title 50, U.S.C., Sec 2401, et Seq. Violations of these export laws are subject to severe criminal penalties. Disseminate in accordance with provisions of DoD Directive 5230-25. This also applies to all subcontractors at every level. In the event that a potential offeror is a foreign company, they must comply with and obtain any necessary licenses required by, the Arms Export Control Act and implementing regulations, prior to obtaining the reference technical manual. To obtain a copy of Technical Manual TM 9-1230-781-13&P, Munition Control Unit Maintenance Instruction and Remote Control Unit Cloning Guide: Interested parties must mail/e-mail a signed and approved DD Form 2345 Military Critical Technologies Data Agreement, a copy of their applicable license issued by the U.S. Department of State if the offeror is a non U.S. company, a completed AMSTA AR Form 1350 Technical Data Questionnaire, and a completed and signed Non-Disclosure/Non-Use Agreement to: Army Contracting Command - Picatinny ACC-PICA-CC Bldg 9, Phipps Rd. Attn: Ms. Nadine Schneider Picatinny Arsenal, Picatinny, NJ 07806 nadine.schneider@us.army.mil Please see Section J for copies of the AMSTA AR Form 1350 (Attachment 0007), DD Form 2345 (Attachment 0008), and Non-Disclosure/Non-Use Agreement (Attachment 0009). Registration In accordance with Part 122.1(a) of the ITAR, any person who engages in the United States in the business of either manufacturing or exporting defense articles or furnishing defense services is required to register with the U.S. Department of State, Directorate of Defense Trade Controls unless an exemption to the registration requirement under the ITAR applies. Registration is primarily a means to provide the U.S. Government with necessary information on who is involved in certain manufacturing and exporting activities and does not confer any export rights or privileges. Registration is a precondition to the issuance of an export license or other approval under the ITAR. Evidence of registration will be required prior to engaging in the manufacture of the item, the furnishing of the service or the exporting or temporary importing of the defense article, defense service or technical data. Exemptions to the requirement for registration can be found in Part 122.1(b) of the ITAR. Licensing In accordance with Parts 123.1 and 125.1 through 125.2 of the ITAR, any person who intends to export or temporarily import a defense article or export technical data, both classified and unclassified, must obtain the approval in the form of a license granted by the Directorate of Defense Trade Controls prior to the export or temporary import, unless the export or temporary import qualifies for an exemption under the provisions of the ITAR. Exemptions to the requirement for licensing, as well as exemption certification requirements, can be found in Parts 125.4 through 125.6 of the ITAR. Violations and Penalties Violations of the Arms Export Control Act and the ITAR can result in severe civil and criminal penalties. A detailed description of the types of violations and associated penalties can be found in Part 127 of the ITAR.
