- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: The Louis Stokes Cleveland, Department of Veterans Affairs Medical Center, 10000 Brecksville Rd, Brecksville Ohio, 44141, VISN 10 Contracting Activity, Acquisition Management Service will conduct the proposed contracting action using other than full and open competition for the proposed contractual action related to Purchase Request: #541-11-3-5756-0925. 2.Nature and/or Description of the Action Being Processed: The Louis Stokes Cleveland VAMC solicited with Toshiba America Medical Systems on May 10, 2011, using unusual and compelling urgency procurement procedures in accordance with FAR Part 13.106-1. The Bio-Medical Department required an emergency purchase of a Tri-Focus X-Ray tube switch for of its Vascular X-Ray system, KXO-100G, VA ID# 53928. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The tube that was replaced by Toshiba was identified to have a defective rotor bearing and required immediate replacement. The identified defect required an emergency procurement to ensure the system would operate at full capacity. Estimated value of part (1ea) and service totaled: $53,900.00. Based upon the urgent requirement, request was processed on May 10, 2011 and was completed on May 12, 2011. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 U.S.C. 253 (c) (2) implemented by FAR 6.302-2 (2) Unusual and Compelling Urgency ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority Without the system operating at full capacity; patient care would have been severely impacted. Delay of the buy would have delayed/cancelled all vascular exams for all the Medical Center's patients until the tube could be properly replaced. This requirement precluded full and open competition under the urgent and compelling circumstances. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The determination to limit the number of sources solicited was based upon the importance to ensure direct continuity of care for the Medical Center's Veterans. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Analyses of costs have been fully reviewed. With the analysis of costs for emergency service for this type of service the Contracting Officer has determined that the costs to the Government are fair and reasonable and the best value for the Government. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: See #6 above 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: See #6 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Emergency repairs of high value Medical Equipment systems i.e. MRI, X-ray machines preclude full and open competition are vital to direct patient care. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
