- The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Linde, LLC of Murray Hill, New Jersey for the purchase of Helium-3 gas to be used for the refurbishment of NIST's existing Ordela SANS detectors under other than full and open competition by the authority of FAR subpart 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements. NIST owns several Ordela neutron detectors which are used on multiple neutron scattering instruments in use at its Center for Neutron Research. The largest of thee specialized detectors are two-dimensional detectors in use on the two Small Angle Neutron Scattering (SANS) instruments. These instruments require periodic refurbishment and/or repair. These particular detectors, the Ordela model 2660N, can only be repaired and calibrated by Ordela due to its exclusive access to proprietary parts, technology, and access to design schematics. In order to maintain its quality control standards, Ordela requires Helium-3 with the following specifications: Gas: Helium-3 Purity: Isotopic Enrichment: 99.9%, Chemical: 99.999% Cylinder: Smallest size possible with highest possible pressure, CGA580 Valve The Department of Energy controls the supply of Helium-3 for the United States and only licenses Linde North American, Inc. for the distribution of Helium-3. These Helium-3 distributions are allowed only through the 3He sub-IPC (Helium-3 sub-interagency policy council), a federally organized program of annual allocations which are reviewed and approved for each federal agency. Therefore, Linde LLC is uniquely qualified to provide the required Helium-3 gas. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor's commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 325120, and the size standard is 1000 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on August 8, 2010. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
