- SOLE SOURCE JUSTIFICATION Description: This is a special notice that Naval Special Warfare Group One, San Diego, CA intends to award a Sole Source Firm Fixed Contract to Skydive Arizona, Inc., 4900 N. Taylor St., Eloy, Az. 85231 under authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1 (b) (1). This notice is not a request for offers, the contractor identified is the only known source for the subject requirement. Responses to the notice will be used to determine if bona fide competition exists only. Any such responses must be in writing and include technical and pricing information. The Government will not pay for any information submitted. All responses from responsible sources will be fully considered. A determination by the Government not to compete this procurement action, based on responses to this notice is solely within the discretion of the Government. Solicitation number H92240-11-T-7021 is issued as a special notice. The solicitation document and incorporated provisions and clauses are those in effect through FAC 2005-43. See Numbered Note 22. This is a simplified acquisition for small business concerns using FSC: 6910 NAICS:481219, SIZE: $5.0 MIL F.O.B -N/A. CLIN 0001: QTY 15.25 HOURS - AIRCRAFT SUPPORT TIME IN ACCORDANCE WITH THE PERFORMANCE WORK STATEMENT CLIN 0002: QTY 9.25 HOURS - VERTICAL WIND TUNNEL TIME IN ACCORDANCE WITH THE PERFORMANCE WORK STATEMENT. PERFORMANCE WORK STATEMENT (PWS) NSWG-3 LOGISTICS SUPPORT UNIT/SEAL DELIVERY VEHICLE TEAM ONE (SDVT-1) SKYDIVE ARIZONA 1.0 BACKGROUND 1.1 Naval Special Warfare Command is required to be provided with annual/sustainment instruction and training in advanced skydiving techniques and skills in order to execute particular assigned mission taskings directed by SOCOM. 2.0 SCOPE/OBJECTIVE 2.1 The Government seeks a qualified Contractor to provide aircraft support and vertical wind tunnel time in order to facilitate training and proficiency jumps. 3.0 PERFORMANCE REQUIREMENTS 3.1GENERAL: The contractor will provide a secure area for miltary personnel to execute packing and rigging of government owned parachutes.. The Contractor shall provide aircraft support hours for 14 military personnel totaling 15.25 Aircraft support hours and 9.25 Vertical wind tunnel rental hours. The contractor will provide vertical wind tunnel time with a safety observer from the wind tunnel staff. 3.2 Travel: All travel will be expense of the military to the jump location. Contractor travel is not applicable since military personnel will transit to the contractor's location. 4.0 QUALITY ASSURANCE 4.1 The contractor will ensure all aircraft used meets all required FAA inspections. 5.0 CONTRACTOR QUALIFICATIONS/REQUIREMENTS 5.1 The Contractor shall provide personnel fully capable of providing the aircraft support and vertical wind tunnel time and have the knowledge, skills and expertise to meet the requirements specified in this PWS. Contractor shall provide support in accordance with applicable Federal, State and local laws and regulations. 5.2 Security Requirements: No security clearance is required for the contractor. 6.0 CONTRACTOR PERSONNEL 6.1 The Contractor shall furnish sufficient personnel to perform all work specified within this contract. 6.1.1 The Contractor is required to comply with Public law 105-270, Section 5 (2) (A). This law states that Contractors will not perform inherently governmental functions. Section 5(2)(A) of this Public law defines the term "inherently governmental function" as "a function that is so intimately related to the public interest as to require performance by Federal Government employees." Per Section 5(2)(B), inherently governmental function include management of Government programs requiring value judgments, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter-intelligence operations. Per Section 5(2)(C), inherent governmental functions DO NOT include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials or (ii) any function that is primarily ministerial and internal in nature." 6.1.2 When performing work associated with this PWS, the Contractor shall make clear to all individuals they deal with that they are Contractor employees and not DOD personnel when working in any situation where their contractor status is not obvious to third parties. Contractor personnel shall be clearly identified (i.e. company shirt, pin, visible company ID, etc.) in a visible location as to who their employer is. All Contractor produced documents, and/or reports shall be suitably marked as Contractor products or that Contractor participation is appropriately disclosed. 6.1.3 Contractor personnel shall not manage, supervise, direct, or task US military, DOD civilians or other personnel not associated with the Contractor while performing the tasks within this PWS. 6.1.4 Contractor personnel shall not establish an employee-employer relationship with the US Navy under this PWS. 6.1.5 The Contractor shall not provide personal services to Navy personnel. If Contractor employees are directed by any government employee at any time to perform services not covered under this contract, the Contractor shall immediately notify the Technical Point of Contract (TPOC).
