- Draft Statement of Work The U.S. Nuclear Regulatory Commission (NRC) is issuing this Small Business Sources Sought notice as a means of conducting a market survey to determine the availability and potential technical capability of the business community to provide all management, supervision, administration, and labor for the NRC Office of Enforcement's Alternative Dispute Resolution Program. This is NOT a solicitation for proposals, proposal abstracts, or quotations. The purpose of this notice is to obtain information regarding: (1) the availability and capability of qualified small business sources; (2) whether they are small businesses; HUBZone small businesses; service-disabled, veteran-owned small businesses; 8(a) small businesses; veteran-owned small businesses; woman-owned small businesses; or small disadvantaged businesses; and (3) their size classification relative to the North American Industry Classification System (NAICS) code for the proposed acquisition. Your responses to the information requested will assist the Government in determining the appropriate acquisition method, including whether a set-aside is possible. An organization that is not considered a small business under the applicable NAICS code should not submit a response to this notice. The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 541990. The NRC requires the services of an organization to provide comprehensive case management services from initial contact by a potential party through completion of a potential settlement agreement. These services shall include: i. Services of an intake neutral to process each case in a timely and efficient manner; and ii. Maintenance of a nationwide roster of highly qualified individuals available to perform session neutral services, on short notice, and aid the parties in resolving disputes related to the NRC enforcement program. The Draft Statement of Work for this effort can be found as an attachment to this notice. The acquisition will be for one (1) 12-month period with four (4) 12-month options. It is noted that these support services are currently performed by Cornell University. THERE IS NO SOLICITATION AT THIS TIME. This request for capability information does not constitute a request for proposal; submission of any information in response to this market survey is purely voluntary; the Government assumes no financial responsibility for any costs incurred. MANDATORY QUALIFYING CRITERIA: Organization's responding to this notice must have: 1) Experience providing comprehensive case management services from initial contact by a potential party through completion of a potential settlement agreement. 2) Experience providing services of an intake neutral to process each case in a timely and efficient manner. 3) A nationwide roster of highly qualified individuals available to perform session neutral services, on short notice, and in geographically dispersed locations. SUBMISSION REQUIREMENTS: If your organization has the potential capacity to perform these contract services, please provide the following information: 1) Organization name, address, email address, website address and telephone number as well as size and type of ownership for the organization; 2) A tailored capability statements addressing the particulars of this effort, with appropriate documentation supporting claims of organizational and staff capability. Your organization's capability statement must: a. Describe your organization's: i. Experience providing comprehensive case management services from initial contact by a potential party through completion of a potential settlement agreement. ii. Experience providing services of an intake neutral to process each case in a timely and efficient manner. b. Provide your organization's national roster of available session neutrals. The roster shall detail: i. The name and geographic location of each session neutral; ii. Years of experience and number of mediations conducted by each session neutral. iii. Indication if a session neutral has knowledge of and experience mediating issues involving Employment Law and, in particular, experience mediating issues involving discrimination allegations; iv. Indication if a session neutral has knowledge of and experience mediating issues involving NRC statutes and regulations in particular NRC's employee protection regulations. Organizations responding to this market survey should keep in mind that only focused and pertinent information is requested. If significant subcontracting or teaming is anticipated in order to deliver technical capability, organizations should address the administrative and management structure of such arrangements. Taking into account the magnitude of the scope of this professional recruitment effort, organizations also should address the capacity of their financial infrastructure to coordinate and deliver contract performance. Interested firms responding to this Small Business Sources Sought Synopsis are encouraged to structure capability statements in the order of the area of consideration noted above. All capability statements sent in response to this notice must be submitted electronically, via e-mail, to Jennifer A. DeFino, at Jennifer.DeFino@nrc.gov, in either MS Word or Adobe Portable Document Format (PDF), no later than 5:00 PM EST on Wednesday, August 03, 2011. This market survey is being conducted through the FedBizOpps to reach the widest possible audience and to gather current market information. GOVERNMENT EVALUATION: The Government will evaluate market information to ascertain market capacity to: 1) potentially provide the services consistent in scope and scale with those described in this notice and otherwise anticipated; 2) potential capacity to secure and apply the full range of corporate financial, human capital, and technical resources required to successfully perform the requirements; 3) potential capability to implement a successful project management plan that includes: compliance with schedules; cost containment; meeting and tracking performance; hiring and retention of personnel; and risk mitigation; and 4) potential to provide services under a performance based service acquisition contract. DISCLAIMER AND NOTES: Any organization responding to this notice should ensure that its response is complete and sufficiently detailed to allow the Government to determine the organization's potential capability and capacity to perform the subject work. The Government may provide access to the information contained in the response to a contractor providing acquisition planning and strategic technical assistance support to the Government. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted. After a review of the responses received, a pre-solicitation synopsis and solicitation may be published in Federal Business Opportunities. However, responses to this notice will not be considered adequate responses to a solicitation.
