- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, VISN 12, Milwaukee Medical Center. 695-11-3-969-0125. 2. Nature and/or Description of the Action Being Processed: Justification and approval for other than full and open competition for the purchase of Operating Room Surgical Booms and Video Integration systems for the VA Medical Center in Milwaukee, WI. This procurement will proceed on a sole source basis with AMERICAN MEDICAL DEPOT, the sole distributor of Stryker Communications. Replacement equipment purchase, firm fixed price. 3. Description of Supplies/Services Required to Meet the Agency's Needs: VA Milwaukee has currently installed Stryker Boom and Video integration systems in our Operating Room 5. The systems were exposed to water from a broken fire sprinkler system in Operating Room 5. The components are beginning to rust and fail, requiring them to be replaced. Only part of the Operating Room 5 boom components require replacement. 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source. (41 U.S.C. 253 (c)(1)). 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Stryker is the only manufacturer that can replace these parts and provide us with a renewed warranty. The products outlined in the solicitation are compatible with the existing Stryker equipment in that space that will remain after this procurement and installation. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The end-users conducted market research and have evaluated others equipment and its capabilities. Other competitors were determined not to meet the VA's specific compatibility needs. Contracting Officer posted an intent to sole source on FBO. Contracting Officer received a few inquires of similar products, however in this case Stryker equipment is needed to maintain the warranties on all existing equipment. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: In accordance with past procurement history, for similar equipment, the anticipated cost of this equipment is determined to be fair and reasonable. The initial equipment was installed fall 2010. The cost to replace all equipment in Operating Room 5 would be close to $500,000 compared to $200,000 for these replacement components. Additionally there would be construction costs for another vendors system. As well as additional cost for another vendor to install support mounts above ceiling to meet the requirements of their equipment. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: End users and Contracting Officer both conducted research. Contracting Officer searched VetBiz and revealed zero Veteran Owned Small Businesses using keywords "surgical booms" and "video integration" A search of CCR's Dynamic Small Business Search revealed no small buisnesses, using the same keywords. In accordance with FAR Part 10, market research was conducted and the VA will post a synopsis of the proposed acquisition, advising industry of the pending acquisition, and soliciting inquiries from interested parties. 9. Any Other Facts: None 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: All competitors were determined to not meet the VA's needs for a reasonable cost. Again, in accordance with FAR Part 10, market research was conducted and the VA will post a synopsis of the proposed acquisition, advising industry of the pending acquisition, and soliciting inquiries from interested parties. 12.
