Attachment B: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval for Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 01, VA Boston Healthcare System, Jamaica Plain Campus, National Center for Posttraumatic Services, Behavioral Science Division, (NC for PTSD, BSD) proposes to enter into a contract on a basis of other than full and open competition with Illumina, Inc., 9885 Towne Centre Drive San Diego CA 92121 for purchase of supplies for genetic research on PTSD, specifically chips which are part of technology for studying genetic variation. Request # 523-11-2-1871-0065. 2.Nature and/or Description of the Action Being Processed: A firm-fixed price sole source contract for the purchase of genetic chip supplies that will be used in research conducted by Dr. Mark Miller on the psychopathology of PTSD. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The requirement of this contract is to purchase 10 HumanOmni1-Quad v1.0 DNA Analysis BeadChip Kits. Each HumanOmni1-Quadv1.0 DNA Analysis Kit multiuse (96) includes reagents to process a total of 96 DNA samples. This kit provides beadchips and reagents enabling the Infinium MultiUse workflow allowing for a single amplification step and usage on up to two additional Omni arrays. These chips will be used in research conducted by Dr. Mark Miller on the psychopathology of PTSD. 4.Statutory Authority Permitting Other than Full and Open Competition: The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1)(or 10 USC 2304(c) (1)) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Qualifications: These chips will be used with existing Illumina equipment in the laboratory of affiliate Dr. Clint Baldwin, Professor, Boston University School of Medicine, Biomedical Genetics. Illumina is the only provider of supplies to be used with their specialized genetic analysis equipment. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A combined synopsis/solicitation, VA-241-11-RQ-0676, was posted on FBO for five business days from May 5, 2011 - May 11, 2011 and there were no responses received. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated dollar value of the proposed acquisition is $336,009.60. The Contracting Officer determined that the anticipated price will be fair and reasonable based on the fact that Illumina is the sole manufacturer of these items and the items are not available for sale through any other vendor. The requirement was posted on FBO and no responses were received. The vendor, Illumina, is providing a $96,000 discount off of the retail pricing making this a best value for the government. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The cost for this contract is based on a quote supplied by the vendor. The vendor has discounted the total cost by 22% which is similar to quotes provided for the initial purchase of the equipment and of subsequent supplies purchased by Boston University. In addition, the requirement was posted on FBO and no responses were received. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Competition is not planned. Illumina is the only manufacturer of these specialized chips that are compatible with their technology and equipment. The cost to purchase another brand of chips would require the additional expense of purchasing a technology package that would be compatible with the chips at an estimated cost of $500,000.00. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Contracting Activity will continue to encourage brand name of equivalent specifications.
