DEPARTMENT OF VETERANS AFFAIRS Justification and Approval Under Simplified Acquisition Procedures (SAP) For Restricting Competition under FAR 13.106-1(b)(1) "Single Source" 1.Contracting Activity: Department of Veterans Affairs, VISN 20 Contracting, Supply Team A. Amanda Glade, Purchasing Agent (208) 429-2019; amanda.glade@va.gov Requestor: Boise VA Medical Center, Biomedical Maintenance Service, Jeff Entringer, Point of Contact (208) 422-1594; jeffrey.entringer@va.gov 2.Nature and/or Description of the Action Being Processed: This procurement under Purchase Request 531-11-3-5047-0385 for a critical part (Anode High Voltage Transformer for GE Light Speed 16 slice CT with GRE console) to repair our CT scanner, that went down over the Memorial Holiday Week end. This Anode High Voltage Transformer is required to operate the equipment. Our CT scanner is Mission Critical to the BVAMC. If we are not able to obtain this part within the week, there is a very high probability that we will have to send patients out for studies, which will increase expenditures and have a direct impact in patient care. 3.Description of Supplies or Services Required to Meet the Agency's Needs: Emergency purchase of a Anode High Voltage Transformer for GE light speed 16 slice CT with GRE console. Estimated cost of the acquisition is $12,900.00. This acquisition is not expected to exceed the Simplified Acquisition Threshold, therefore, in accordance with FAR 5.202(a)(13), this action will not be advertised. 4.Statutory Authority Permitting Restriction in Competition: The statutory authority for restricting competition under SAP, or Single Sourcing, for acquisitions under $150,000 or Simplified Acquisition Threshold (SAT) is FAR 13.106-1(b)(1). The reason for restricting competition for this purchase is based upon the urgent and compelling circumstances of the requirement. The Boise CT scanner is Mission Critical to continued patient care. If we are not able to obtain this part within the week, there is a very high probability that we will have to send patients out for studies, which will increase expenditures and have a direct impact in patient care. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This request is urgent and compelling. Because we have an existing In-House Assist Service Agreement in place, with the Vendor, we are able to obtain Original Equipment Manufacturer (OEM) parts at a 15% discounted rate and parts are in stock and are shipped over-night. Vendor selected is the Original Equipment Manufacturer for equipment being repaired. Part/Service is required Urgently to Maintain Continuity of Patient Care, Delivery Time Essential to Patient Care. 6.Description of Efforts Made to Ensure that Offers are Solicited from As Many Potential Sources as Deemed Practicable IAW FAR 13.104: Not Applicable: GE OEM CT Scanner parts only available from the Original Equipment Manufacturer (OEM). Use of non-OEM repair parts would conflict with VA260-P-0742 Maintenance Contract (covering services) and might damage critical and expensive components and result in vastly increased repair parts, for which GE could not be held responsible to rectify. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable - IAW FAR 13.106-3: Part cost is determined to be fair and reasonable. Part offered at best customer catalogue price. Also, IAW the terms and conditions of VA contract VA260-P-0742, the VA acquires all service parts at a 15% discount off this pricing. 8.Description of the Market Research Conducted and the Results, or Statement of Reasons Market Research was not Conducted (FAR 10): Market research was not conducted by the Biomedical Department because OEM parts are available to the BVAMC from GE at a 15% discounted rate, IAW the Terms and Conditions of VA contract VA260-P-0742. The OEM was contacted and we determined that the part was in stock, available for immediate shipment and could be shipped overnight in order to maintain an uninterrupted patient schedule, thus maintaining the continuity of patient care. 9.Any Other Facts Supporting the Restriction of Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: GE Healthcare Technologies OnDemand Services P.O. Box 4144 (W-503) Milwaukee, WI 53201 11.Statement of Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making Subsequent Acquisitions for the Supplies or Services Required: \ Not Applicable. Overwhelming high sunk costs involved with CT Scanner preclude system replacement at this time. Also, GE maintenance contract indispensable to efficient operation of the scanner, therefore that will not be abandoned in the near term. For as long as we are dependent upon GE for maintenance we are locked into using OEM parts. 12.
