Description

VA-69D-11-RQ-1128 The Great Lakes Acquisition Center (GLAC) in Milwaukee, WI intends to negotiate on a sole source basis (IAW FAR 13) with NXStage Medical, Inc of Lawrence, MA as the only distribution source that provides The NxStage System One Portable Hemo-Dialysis Machine used for patient care. NXStage Medical, Inc is the only company that makes a Portable Hemo-Dialysis Machine that meets our requirement and that is compatible with current equipment at Hines. Specifically, the contractor shall provide the following: - (1) NxStage System One Dialysis Machine and one (1) Fluid Warmer with all associated equipment and supplies (Quantity: 1 Each); This acquisition is being conducted under simplified acquisition procedures (IAW FAR 13). There are no set-aside restrictions for this requirement. The intended procurement will be classified under North American Industry Classification System (NAICS) 339112 with a Small Business Size Standard of 500 employees. This notice of intent is not a request for competitive proposals and no solicitation document exists for this requirement. However, parties interested in responding to this notice will need to submit technical data sufficient to determine capability in providing the same product. All capability statements received within 5 days after publication of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Capability statements shall be submitted by email only as a MS Word or Adobe PDF attachment to Scott Ivy at scott.ivy@va.gov Statements are due by 12:00 CST 14 July 2011. No phone calls accepted. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Sole Source for (1) NxStage System One Dialysis Machine and one (1) Fluid Warmer, for Hines VA VA-69D-11-RQ-1128 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 5000 W. National Avenue, Milwaukee, WI 53295. 2. Nature and/or Description of the Action Being Processed: Justification and approval for Other Than Full and Open Competition for the purchase of one (1) NxStage System One Dialysis Machine and one (1) Fluid Warmer for the Edward Hines VA Hospital in Hines, IL per Purchase Request# 578-11-3-969-0209. Award of a new firm-fixed price contract is anticipated. This procurement will proceed on a sole source basis with NXStage Medical, Inc. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Edward Hines VA Hospital has a requirement for one (1) NxStage System One Dialysis Machine and one (1) Fluid Warmer. The total for the system is $30,500.00. Delivery is expected within 90 days of the Notice of Award. 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c)(1)). 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The NxStage Dialysis Machine is the only product that has the following unique features: Is the only portable hemo-dialysis machine on the market. The VA needs to be able to do the following: provide instant care instead of a typical 3-4 hour hemodialysis session. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Other vendor's products were evaluated but did not have all the required features. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The same items were purchased 7 times on FBO at comparable prices. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The contracting officer called all companies on GSA and no one could deliver a portable hemodialysis unit. A review of dialysis machines on the internet also did not reveal any comparable brand able to perform to the requirements. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: intends to award a sole source award to NXStage Medical, Inc. of Lawrence, MA, for the purchase of an NxStage System One Dialysis Machine and one (1) Fluid Warmer. This machine allows slow continuous renal replacement therapy (CRRT) which is an ideal therapy for critically ill patients with acute hemodynamic instability. Traditional hemodialysis is sometimes not possible in critically ill patients with acute renal failure. CRRT is ideal for patients with hemodynamic instability, post surgical patients with volume overload, liver failure patients, extremely catabolic patients, and patients with CHF and oliguria. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None. 12.
