- Bid Schedule FAR Clauses by Reference THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FEDERAL ACQUISITION REGULATION SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION AND PROPOSALS ARE HEREBY BEING REQUESTED. Solicitation NRCS-FL-11-04 is issued as a request for proposals (RFP's). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-52. The United States Department of Agriculture, Natural Resources Conservation Service (NRCS), Gainesville Florida State Office intends to award Multiple Award IDIQ contracts to sources capable of providing and installing barbed wire fencing on Wetland Restoration projects (WRP) which vary in acreage from 500-11,000 acres plus/minus. SCOPE OF WORK: Background: The Wetlands Reserve Program (WRP) is a voluntary program offering private landowners the opportunity to protect, restore, and enhance wetlands through the conveyance of a conservation easement to the United States of America. The United States Department of Agricultural (USDA), Natural Resources Conservation Service (NRCS) administers WRP. The goal of the program is to restore wetlands functions and values and associated uplands on all acres enrolled. The program provides landowners with the opportunity to establish long-term conservation and wildlife practices for the benefit of restored habitats. An important conservation practice often used to ensure restored properties to attain their long-term restoration goals requires the installation of Fence - Code 382 in accordance to NRCS standards and specifications. Fence - Code 382 is used to establish a barrier for animals, most typically livestock, and people in an effort to control access. Controlling access through the establishment of effective boundary fence is often required for NRCS conservation easements to protect structural and managerial type conservation practices to allow practices to perform properly and remain functional through their intended life. Many of NRCS's conservation easements, especially those associated with wetland restoration, utilize the positive effects of controlled livestock grazing, Prescribed Grazing - Code 528, as a management practice to achieve desired ecological community structure and function. The use of interior crossing fencing is essential in controlling the timing, frequency, duration, and intensity of livestock grazing on NRCS restored easement properties. Fence - Code 382 is also used to establish livestock enclosures or Access Control - Code 472 to temporary or permanently exclude animals, people, vehicles and/or other equipment from an area needing protection. It is anticipated Fence - Code 382 will be required at levels ranging from hundreds of feet to 10 miles in length depending on the circumstances of the project area. THE PURPOSE OF THIS CONSERVATION PRACTICE IS TO: 1) Protect newly planted areas from disturbance until plant establishment. 2) Protect sensitive environmental areas from animal or human traffic. 3) Reduce erosion and water quality degradation by controlling livestock access, to streams, springs, wetlands, and ponds. 4) Improve the distribution and timing of livestock grazing. 5) Facilitate the handling, movement, watering, and feeding of livestock. 6) Protect people, livestock, or wildlife from hazardous areas. DESCRIPTION OF WORK: The work consists of installing barbed wire fence, gates, corners, and associated support bracing at predetermined locations on NRCS conservation easement projects. The fence will be installed along designated boundary lines, interior cross fencing and other predetermined area requiring access control within the easement project area. Gates, corners and support bracing will be installed at locations designated on plans or maps or as staked in the field by NRCS staff. Fence, gates, and bracing materials shall be installed according to the USDA, Florida Natural Resources Conservation Service (NRCS) standards and specifications, Fence - Code 382. GENERAL REQUIREMENTS: Work must comply with all Federal, state, and local laws as required. CERTIFICATIONS: The Contractor must be licensed/certified in the State of Florida to install fence as required in this Request for Proposals. PERFORMANCE SCHEDULE: All work covered under this solicitation shall be completed within 30 calendar days (negotiable based on the size of the project) after the receipt of the government's written notice to proceed (NTP) by the NRCS Contracting Officer (CO). The contractor shall begin work not later than 7 calendar days after receipt of written NTP. CONTRACTOR'S RESPONSIBILITY: The Contractor is responsible for the installing the fence and gates in accordance with NRCS conservation practice standard and specifications, Fence - Code 382. Review of delivered work and acceptance will be the basis of final payment for the work. The Contractor shall be responsible for the professional quality and technical accuracy of the installed Fence(s) and other services furnished under this contract. The contractor shall, without additional compensation, correct or revise any errors or deficiencies in submittal including drawings, maps, or other services. Vehicles used during the construction will be suitable for off- road terrain (minimum impact to landscape). All GPS equipment shall be of such design and in such condition and adjustment that results obtained will fulfill and maintain the degree of accuracy required. The contractor shall furnish all personnel for the work and each person shall be fully qualified for the work he/she is to perform. All state and local laws pertaining to the services to be performed shall be met, including corporate or company registrations where required, as well as individual registrations. Meeting all state certifications as it relates to these services are mandatory, and must be obtained before the awarding of the contract. All equipment necessary to perform the work required shall be furnished by the contractor. All GPS equipment shall be of such design and in such condition and adjustment that results obtained will fulfill and maintain the degree of accuracy required. INSTALLATION: 1. Mandatory pre-installation conference will be held by the Contracting Officer's Technical Representative (COTR). Minutes of the meeting shall be prepared by the Contractor and submitted to the COTR within 7 calendar days of the meeting. 2. Verification that required permits have been obtained prior to construction. 3. Staking and layout according to plans and specifications including applicable construction layout notes. 4. Installation inspection (according to quality assurance plan as appropriate). a. Actual materials used (Part 512, Subchapter D Quality Assurance Activities, 512.33) b. Inspection records including photos of the work throughout the installation process. 5. Facilitate and implement required design modifications with NRCS. 6. Advise NRCS on compliance issues with all federal, state, Tribal, and local laws, regulations and NRCS policies during installation. CONSTRUCTION CHECK OUT: 1. As-Built documentation. a. Extent of practice units applied b. As-built drawings c. Final quantities 2. Certification that the installation meets Florida NRCS standards and specifications and is in compliance with permits. 3. Exit conference with NRCS. 4. GIS Shapefile of the location of the installed fence alignment. DELIVERABLES: The Contractor will provide NRCS with three hard copies and one electronic copy of all reports. Where reports are required for approval, a single report is acceptable at the time of submission, with the remaining deliverable being forth coming after the NRCS approval. All pictures and maps will be submitted in a hard copy and electronic format. The GPS points will be provided in an electronic format. THE DELIVERABLES WILL BE PRESENTED IN THE FOLLOWING FORMATS: 1. Reports, certification of completion, photos, etc.: Microsoft Word document 2. Maps - PDF document and GIS polygon shapefile (projected to UTM - NAD 1983, Zone 16 or 17). GOVERNMENT FURNISHED DOCUMENTS: The CO will provide the Contractor task orders with written plans and specifications including sketches and drawings that adequately describes the requirements of the Fence(s) to be installed. Information provided will include the following: 1. Digital maps of the easement area and proposed locations of desired Fence(s). 2. Ingress and egress routes of the property 3. Purpose of the intended Fence(s) and other information important to the proper construction 4. Desired location/alignment of Fence(s) and gates 5. Minimum number of wires and their appropriate spacing 6. Minimum top diameter of corner and brace posts 7. Minimum top diameter of line posts and their spacing 8. Type and quality of materials to be used in the construction of the Fence(s) TASK ORDER PERFORMANCE: Task orders for various projects will be competed among the successful offers for award. Once award is made, the Project Start (PS) date shall be within 7 days of award. The COTR will meet with the Contractor to conduct a site showing once a task order is awarded. INSPECTION AND ACCEPTANCE OF DELIVERABLES: During the process of the work, any inspection of the work by the CO or COTR shall be solely at their option. All work, and all of the Contractor's or Subcontractor's office, equipment, and personnel engaged in the work, shall be subject to and available for inspection by the CO or COTR upon receiving a two (2) week notice of the inspection. The COTR will have 10 working days to complete its review of the deliverables. The COTR will accept or reject the deliverables in writing. In the event of rejection of any deliverable, the Contractor shall be notified in writing by the COTR, giving the specific reason(s) for rejection. The Contactor shall have (7) working days to make corrections to the rejected deliverable(s) and return it to the COTR. Review of delivered work and acceptance will be the basis of final payment for the work. The Contractor shall be responsible for the professional quality and technical accuracy of the reports, maps, questionnaires, and other documents furnished under this contract. The contractor shall, without additional compensation, correct or revise any errors or deficiencies of the installed Fence(s), reports, maps, or questionnaires. CONTRACT TYPE & PERIOD OF PERFORMANCE: The Government intends to award up to 3 IDIQ Contracts with a base year and 4 option years to responsible/responsive offerors. The minimum amount under these contracts will be $500 (payable in the first year only), and the maximum is $1,000,000 over the life of the contract. This is a full and open competition. The NAICS Code is 238990. The provisions of FAR 52.212-1, Instructions to Offerors-Commercial Items applies to this acquisition. Offerors must submit a completed copy of the provisions at FAR 52.212-3, Offerors Representations and Certifications - Commercial Items (complete and submit with their offer). In addition, the provisions of FAR 52.212-4 Contract Terms and Conditions - Commercial Items and FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial items apply to this solicitation and are attached. Clause 52.215-2 Audit and Records-Negotiation, is included by reference. EVALUATION PROCEDURES: The following factors shall be used to evaluate offers and are listed in descending order of importance: 1. Copy of contractors' license showing professional qualifications necessary for satisfactory performance of required services. 2. Capacity available to perform multiple fencing jobs concurrently and provide 3 references (name, phone, and address). Government projects in the last 3 years are preferable. 3. List/address past performance on contracts with Government agencies and private industry in terms of quality of work, cost control, and compliance with performance schedules. a. Provide qualifications. b. Provide a plan of operation (outline relevant steps that was taken to complete services or previous task orders). c. Describe how the price was established on similar work (list the relevant factors used to establish the price for previous task orders). 4. Firms shall designate the counties where they are willing to work by providing a list in descending order of interest. (List is Required) More consideration will be given to companies who list central and southern Florida since that is where the majority of our projects are located. Technical and past performance when combined, are equal to 70%. The government intends to award based upon the best value to the Government, cost and price considered. CENTRAL CONTRACTOR REGISTRATION: All contractors must be registered with the Central Contractor Registration (CCR) prior to award. You may register easily and quickly online at www.ccr.gov or 1-888-227-2423. The first step to registering is to obtain a Data Universal Numbering System (DUNS) number, which is a unique nine-character identification number provided by the commercial company Dun & Bradstreet (D&B). To request a DUNS number call D&B at the toll free number 1-866-705-5711 or register online at http://www.dnb.com/ccr/register.html. Obtaining a DUNS number through this process is free of charge. It is advised that you begin this process as soon as possible since it can take several days to complete. Failure to register by close of business on the second day after notification of possible award by the Contracting Officer may cause rejection of your offer. PROPOSAL SUBMISSION: Offerors must submit one original and 3 copies of their proposal addressing the evaluation criteria listed above, a completed copy of FAR 52.212-3, Offerors Representations and Certifications - Commercial Items, and a completed and signed copy of Section B-Cost/Price (attached) by 2:30pm on July 27, 2011 to USDA/NRCS, Attn: Angela Allen, 2614 NW 43rd Street, Gainesville, FL 32606.
