- The Bureau of Reclamation, Yakima Field Office, Yakima WA, intends to soliciate a sole source procurement for a brand name relay tester, Omicron CMC 356 with the following characteristics:CMC 356 Test Unit with Advanced Protection SoftwareCMControl front panel control Option ELT-1 for new CMC 356 Generator combination cable Heavy-duty transport case Enoserv RTS License with OMICRON driver This requirement will be issued under RFQ R11PS1C330 on or before June 30, 2011. This acquisition is a total small business set a-side under NAICS code 334515 with a size standard of 500 employees. This action is applicable to FAR Part 6.302-1(2)(b)(4) as stated:4) When the agency head has determined in accordance with the agency's standardization program that only specified makes and models of technical equipment and parts will satisfy the agency's needs for additional units or replacement items, and only one source is available. (c) Application for brand name descriptions. An acquisition that uses a brand name description or other purchase description to specify a particular brand name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition regardless of the number of sources solicited. It shall be justified and approved in accordance with FAR 6.303 and 6.304. The justification should indicate that the use of such descriptions in the acquisition is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. See 5.102(a)(6) for the requirement to post the brand name justification. (Brand-name or equal descriptions, and other purchase descriptions that permit prospective contractors to offer products other than those specifically referenced by brand name, provide for full and open competition and do not require justifications and approvals to support their use.) All required justificatrions have been completed and includes the following narrative: Reclamation issued and re-issued a solicitation through open competition to procure a relay test set. Of the bids received in both solicitations, none of the bids met the original requirements. In order to procure this equipment with the urgency that is required and to acquire the only suitable relay test set available, the equipment will be sole sourced. The submittals have provided additional market research that the Omicron test equipment is the only equipment that meets the technical requirements identified by the agency, and that it is a good value for the agency. Reclamation-wide test routines and technical support for the Omicron equipment are available, and is one of the most essential needs. This is the only test set which works with Enoserv RTS, has the required interface, has the required input/output capabilities, and meets the voltage-current generation characteristics. Based on market research, the Omicron test equipment is the only test set that meets the technical requirements in order for the Yakima Project to perform testing on its critical equipment. The Government believes that only one responsible source can provide the required test listed above that will satisfy the Agency needs. Any firm or individual that believes it can furnish the items described are encouraged to give written notification to the Contracting Officer. Supporting evidence must be furnished, in sufficient detail to demonstrate the ability to comply with the above requirements. All responses received by close of business July 5, 2011, will be considered by the Government. A determination by the Goverment not to compete this proposed action based on responses to this notice is solely within the discretion of the Goverment. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
