- Description
- It is the intent of the National Library of Medicine (NLM) to enter into a sole source procurement with OpenEye Scientific Software, 9 Bisbee Court, Suite D, Santa Fe, NM 87508 for the purpose of software support and maintenance renewal for proprietary software. The provided supplies and services are proprietary and commercial as defined in Far Part 2. OpenEye Scientific Software is the only known source capable of providing the required supplies and services. This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 6.302-1 and HHSAR 306.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR 13.5 to use simplified acquisition procedures for commercial acquisitions. The North American Industry Classification System Code (NAICS) is 541519 and the business size standard is $25.0 million. This solicitation incorporates provision and clauses in effect in the March 2005-52 FAR Revision effective May 31, 2011, including all FAR Circulars issued as of the date of this synopsis. The period of performance is anticipated to be twelve (12) months, with options to extend the term for two (2) twelve (12) month periods. The Base Year period of performance is anticipated to be July 7, 2011-July 6, 2012, Option Year 1 period of performance is anticipated to be July 7, 2012-July 6, 2013, and Option Year 2 period of performance is anticipated to be July 7, 2013-July 6, 2014. Inclusion of options does not commit the Government to exercise the options and is subject to available funding. NLM anticipates that an award will be made on or about July 7, 2011. This is not a solicitation for competitive quotations, nor is a RFQ available. However, if any other interested party believes that it can meet the requirement it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to all NLM to determine if the party can meet all of the foregoing requirements. Quotations must be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the vendor is capable of successfully performing the requirement. OpenEye Scientific Software is the only known source to NLM that can meet the above requirements due to the proprietary software previously purchased.
