Description of the action being approved:The National Park Service (NPS) shall be soliciting for sewage pumps from Gorman-Rupp vendors only. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR). 3. Description of Supply Gorman-Rupp Pump Model S3A1-46DV39, 5hp industrial submersible with 75' cable, no control panel needed. 4. Authority:a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.b. FAR Part 11.105: The Brand Name products are essential to the Government's requirements, and market research indicates other companies' similar products do not meet and cannot be modified to meet the agency's needs.c. FAR 6.302-1: The use of the name brand products are essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. 5. The description of the product's unique qualifications or the unique nature of the acquisition:This sewage pump will replace an existing pump in the Canyon Wastewater Treatment Plant and the old one will become a backup pump. The two pumps need to be interchangeable. If a sewage pump goes down, the pump has to be replaced immediately. A sewer spill is a hazard to the Canyon area, humans, animals and environment. These pumps have to fit into the existing structure of the plant. This sewer plant is automated; so to change any part would involve a major engineering re-design and the costs would be exorbitant. This would not be a cost effective nor time effective way to use the government's monies. 6. Efforts to obtain competition:a. Efforts to ensure offers are solicited from as many potential sources as is practicable:This special notice is being posted on Fed Biz Ops. Email combined synopsis/solicitation will be sent to interested vendors. 7. Determination that costs will be fair & reasonable:The government will verify the price for the product is fair and reasonable by comparing pricing on identical and similar items purchased recently. The government will also use price analysis completed during product research to make sure that pricing is fair and reasonable. 8. Description of the market research conducted:The government conducted product research and decided that for the application the horsepower and frame size of the Gorman-Rupp model S3A1 best fits into its application. The government compared pump frame size, horsepower, pump curves, pricing and availability of other manufactures. These pumps need to fit into an existing structure, to design and reengineer would not be an efficient use of the government's monies. 9. Other facts supporting other than full & open competition: a. Actions to remove barriers to competition in the future for similar acquisitions:The government is working to develop protocol for new engineering that will be compatible to different pumping platforms. This will make replacement and future upgrades open to further competition.
