- EMERGENCY BANK STABILIZATION CONTRACT, GAVINS POINT PROJECT 1. Scope of Work: Contractor will be required to be on call and be able to respond to the project within 8 hours of a phone call from Mr. Bryan Bradley to perform emergency bank stabilization work in the areas of bank line designated by Mr. Bradley. Work could be on either side of the Missouri River and may extend approximately one mile downstream of the dam. Contractor will be required to provide all equipment and labor to perform this emergency work. Work may require enough equipment to be performing emergency work on both sides of the river at the same time. Contractor will be required to provide a per day on call price and price for the placement per cubic yard of government furnished riprap. The contractor will be required to transport the government furnished riprap from the stockpile area north of the dam to the required areas to be repaired. Riprap shall be placed with excavators or cranes. The areas the contractor will be working are generally very congested with traffic and it will be the contractor's responsibility to provide traffic control. 2. Delivery: Following a notice call from Mr. Bradley, the contractor will be required to be on site and placing riprap within 8 hours. The contractor shall make the equipment available to the Government at the price stated in the contract until the equipment is released by the COR or until 30 days from the date of this contract, whichever is earlier. The Government may exercise a unilateral option to extend the term of the contract by an additional 30 days. 3. Points of Contact: Bryan Bradley is designated as the contracting officer's representative (COR). He may be contacted at his work phone, 402-667-2560, his cell phone, 605-660-3157 or email at bryan.j.bradley@usace.army.mil. The COR and the contractor shall establish and maintain daily coordination and communication throughout the duration of the contract. Any modifications or changes to the contract shall be coordinated through the COR. 4. Materials: Government furnished riprap protection shall be provided in areas designated by Mr. Bradley or his representative. All stone for riprap protection is durable Sioux Quartzite quarried rock.Riprap is well graded Type B stone with the following gradations and weights: Stone Weight in Lbs.Percent Lighter by Weight 500100 30060 to 85 15030 to 50 5015 to 30 150 to 15 5. Protection of Existing Facilities: Contractor shall be responsible for protection of all existing facilities during the construction. Any damage done to the facilities due to the negligence of the contractor shall be repaired at the cost of the contractor. 6. Environmental Protection: In order to prevent, and to provide for abatement and control of, any environmental pollution arising from the construction activities in the performance of this contract, the Contractor and his sub contractors shall comply with all applicable federal, state and local laws and regulations concerning environmental pollution control and abatement. a. Notification: The Contracting Officer will notify the Contractor in writing of any non compliance with the aforementioned federal, state or local laws or regulations. Such notice, when delivered to the Contractor or his authorized representative at the site of the work, shall be deemed sufficient for the purpose. The Contractor shall, after receipt of such notice, immediately inform the Contracting Officer of proposed corrective action and take such action as may be approved. If the Contractor fails or refuses to comply promptly, the contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop orders shall be made the subject of a claim for extension of time or for excess costs or damages by the Contractor. 7. Safety Requirements: A site specific safety plan shall be submitted for approval. No work shall be performed without an approved plan. The Contractor shall ensure that safe working practices are utilized and that all equipment meets the requirements of the US Army Corps of Engineers, Safety and Health Requirements Manual, EM 385 1 1, September 2008, before work begins. A copy of the above manual is available at the Gavins Point Dam Project Office, Yankton, South Dakota P.O. Box 710. Contractor shall submit a site specific safety plan for approval prior to commencement of work. 8. Submittals: Contractor's site specific Safety Plan shall be submitted to the Contracting Officer's Representative for approval prior to commencement of work. 9. Payment: Contractor shall be paid within 30 days of successful installation of riprap and upon the receipt to the project office of a proper invoice. Invoice shall include the contract number.
