Description

The Environmental Protection Agency (EPA), Region 4, intends to award a sole source fixed price purchase order to Waters Corporation.. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 in conjunction with FAR 13.5, as supplemented with additional information included in this notice. The purchase is for 1 year maintenance for the following:1) MS Total Assurance Plan (TAP) with one PM, UPSMPMGR - UPLC Sample Mgr, s/n H09UPA784M, UPBINARY - UPLC BINARY SOL MGR, s/n H09UPB283M, TQD - TRIPLE QUAD DETECTOR, s/n Q58760; and2) MassLynx Software (1 yr plan), s/n MS9EN10633; with 4 1-year options.The authority for this sole source procurement is FAR Part 6.302_1 in that Waters Corporation is the sole manufacturer, distributor and supplier of parts and the only known source that can provide authorized maintenance for their equipment. Waters Corp. parts are required to prevent damage of precision components, which would compromise instrument performance. This is not a request for competitive proposals and no solicitation is available. Firms that believe they can provide the required products are encouraged to identify themselves and give written notification to the Contract Specialist within 15 days from the publication date of this synopsis. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct a competitive procurement. This announcement constitutes the only notice; quotes are not being requested and a solicitation will not be issued.
