- EXCEPTION TO THE FAIR OPPORTUNITY PROCESS FAR 16.505(b)(2) This Exception the Fair Opportunity Process is executed by the Naval Medical Logistics Command, Fort Detrick, MD for supplies or services specified below. The proposed vendor is the only awardee under the available DSCP contracts, per the Memorandum of Understanding between NMLC and DSCP approved on 03 June 2009, capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. Specified below are the vendor, the required supplies or services, total estimated dollar value, and the rationale for the unique or highly specialized nature of the equipment: NNMC Bethesda has a requirement for a radiographic/fluoroscopic system with an estimated total value of $340,000, including installation turnkey, to be procured with FY11 OP funds. The radiographic/fluoroscopic system shall be permanent (not mobile), digital, and shall be intended for general purpose imaging. The system shall have at least a 65kW x-ray generator and a ceiling-mounted tube configuration. The table shall be capable of tilting 30 ° into Trendelenburg position and 90 ° into reverse Trendelenburg position and shall be capable of supporting patients weighing up to 500 pounds. The system shall be capable of providing pulsed fluoroscopy, ranging from 4 frames per second (fps) to at least 15 fps, in order to reduce dose as appropriate while imaging dynamic organs. The system shall include a vertical wall stand, a cassette/grid holder for cross-table studies, and a DVD recorder. The system shall be DICOM compatible and shall include an uninterruptible power supply (UPS). The system shall be compatible with the radiographic/fluoroscopic system in place at the National Intrepid Center of Excellence (NICoE) in order to provide consistent care as patients with traumatic brain injury and post-traumatic stress disorder are imaged and transferred at the Bethesda campus. The system shall have the capability to be upgraded based on clinical and workflow needs. The vendor shall be able to provide turnkey installation. Of the available vendor models that offer a general-purpose radiographic/fluoroscopic system, the GE Precision 500D is the only system that meets the minimum requirements of the government. The GE Precision 500D is compatible with other radiographic/fluoroscopic systems installed on the Bethesda campus, as well as compatible with other radiographic equipment at the command. There are Philips radiographic/fluoroscopic systems installed on the campus, but there have been significant issues with service call response time and the resulting downtimes have delayed the delivery of patient care. There is no current MOU in place to order from another vendor that could meet the needs of the government. Therefore, it is not possible bo do a competitive competition with Phillips. GE has provided satisfactory service call responses and is the only vendor that offers a system that meets the minimum requirements of the government. The contracting office will document the rationale for the placement and price of each order, including the basis for award and the rationale for any tradeoffs among cost or price and non-cost considerations in making the award decision.
