- Professional, Administrative and Management Support for the Bureau of Indian Education (BIE), Division of Performance and Accountability (DPA). This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation, BIE Special Education State Investigator Services and Mediation Services, is issued as a Request for Quote (RFQ). The North American Industry classification (NAICS) code is 624190 Other Individual and Family Services and the business size maximum is $7.0 Million.Note 1: This RFQ has attachments. An interested offeror is responsible for contacting the contracting officer, Marita Roth, marita.roth@bia.gov for a copy of the attachments, if a copy cannot extract from the Federal Business Opportunities. This acquisition is being solicited under full and open competition. The resultant contract will be awarded as an Indefinite Quantity contract as defined in FAR 16.504 with a base and four one year option periods. The Base Period of Performance (POP) shall be from Contract Award to March 31, 2012. Reference Section 14 Period of Performance. The Government plans to make a single contract award. INTRODUCTION:Under the provisions of P.L. 107-110 'No Child Left Behind' (NCLB) and the Memorandum of Agreement with the U.S. Department of Education the Bureau of Indian Education (BIE) is designated as the State Educational Agency (SEA) for 183 instructional and residential programs in 23 states that receive funding under NCLB. The BIE provides oversight and supervision for schools that are funded under P.L. 95-561 that are operated by the BIE and for tribally operated schools that are funded under the provisions of P.L. 100-297 and P.L. 93-638 that receive funding under NCLB. 100% of the students that attend BIE operated and funded programs meet the criterion for being socially and economically disadvantaged which qualifies these schools to receive funding under NCLB.As the SEA for these schools the BIE is responsible for ensuring that students with disabilities are provided with a free and appropriate public education (FAPE) under the Individuals with Disabilities Education Improvement Act, Part B, Section 612(a)(1)(A), December 3, 2004, (IDEA).2. BACKGROUND:Approximately 44,000 students are enrolled in the BIE funded schools, of which approximately 15% are identified as children with a disability according to the Native American Student Information System (NASIS); the Bureau's data system used by BIE funded schools. The SEA is required to meet all components of the IDEA Act of 2004. This act stipulates that each SEA must ensure that each public agency establish, maintain, and implement procedural safeguards that meet the requirements of 34 CFR ?300.500 through ?300.536 Subpart B-Procedural Safeguards Due Process Procedures for parents and children is the component that addresses the processes for dispute resolution. The dispute resolution process as defined in statue and regulation is the enforcement tool of resolving disagreements between parents and schools whenever an alleged violation of the rights of a student with disabilities or a technical violation of the statue has been filed. The dispute resolution processes make available three options for use by parents and schools to resolve dispute: (1) mediation; (2) state complaints; and (3) due process hearings. Due process hearing is the enforcement tool available to the complainant that address matters relating to the identification, evaluation, or educational placement of an eligible child, or the provision of FAPE to a child with a disability. This is the formal process for the dispute resolution process. It also requires the most time and financial resources to both parties. The hearing officers are currently provided through the Office of Hearing and Appeals for the Due Process Hearings. The purposes of this Indefinite Delivery/Indefinite Quantity (IDIQ) contract are:(1) To ensure that the BIE has an effective dispute resolutions system in place as a required component of IDEA;(2) To maintain a list of qualified state complaint investigators to address and investigate disputes in a timely manner as required by the IDEA; and(3) To maintain a list of qualified mediators to address and mediate disputes in a timely manner as required by the IDEA. 3. SCOPEBIE requires the services of a contractor who shall provide qualified individuals who will serve as mediators and state complaint investigators who are knowledgeable about the laws and regulations relating to the provision of special education and related services according to the IDEA BIE funded schools located in 23 States. 6. CONTRACTOR TASKS AND RESPONSIBILITIESThe contractor is responsible for furnishing all equipment, connectivity, supplies, travel, transportation of goods or equipments, or additional professional services needed to carry out the requirements of the solicitation.Also See Attached RFQ
