Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FOR TMACC HVAC REPLACEMENT Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows: 1. Agency and Contracting Activity: The Department of Homeland Security (DHS), United States Coast Guard (USCG), and, Command, Control, and Communications Engineering Center (C3CEN), proposes to enter into a contract on the basis of other than full and open competition. 2. Nature and/or description of the action being approved: Emergency Replacement of 2 AC Units on the TMACC (Transportable Multi-Agency Communications Central) USCG asset located at USCG CAMSLant in Chesapeake Va. The 2 AC Units on the TMACC are not working and need to be removed and replaced with New Units. An evaluation by a Certified Technician has determined that it is not cost effective to have the 2 Units repaired due to the amount of Leaks in the Units. The contractor has provided us with a quote to remove the current HVAC units, and install new units at a price of $26,312.97. This price includes demolition and dispose of existing equipment, installation and reconnection of ductwork as required. Lastly perform startup and verify proper system operation. Description of Supplies/Services: The 2 AC Units on the USCG TMACC Asset are not working and need to be removed and replaced with New Units. An evaluation by a Technician has determined that it is not cost effective to have the 2 Units repaired due to the quantity of leaks in the Units. The Contractor has provided to the USCG a quote to remove the current HVAC units, and install 2 each New Units at a price of $26,312.97. This price includes all Labor and or Materials for demolition and dispose of existing equipment, installation and reconnection of ductwork as required. Lastly perform startup and verify proper system operation. Full name and address of the proposed Contractor HVAC DESIGNS, INC Cage Code#6B4D5 711 Falcon Ave. C-1 Chesapeake, VA 23324 4. Identification of Statutory Authority Permitting Other Than Full and Open Competition: FAR 6.302-2 Unusual & Compelling Urgency. Emergency replacement of 2 AC Units on the TMACC asset to keep this asset Operational in the case of a National Emergency. 5. Demonstration That the Proposed Contractors Unique Qualifications or the Nature of the Acquisition Require Use of the Authority Cited: It is determined that there is an Urgent and Compelling need to have the TMACC in a Fully Operational Ready Status in the case of a National Emergency. The TMACC's Critical Mission is to ready to Deploy in the event of a Emergency & Non-Emergency situation in support of Natural Disasters, Federal Emergencies. The TMACC is a self contained Mobile Communications Center and without A/C controls none of the Electronic Equipment will be able to operate without possible damage to the Equipment, thus rendering the TMACC non-operational. This Contractor anticipates that he can provide the Units and Services to install Units and complete the Job within a 1 week from award of Contract. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under 5.202 applies. A Notice will not be posted via FBO, the exception under 5.202(a)(2) applies to this requirement. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The total Cost of this Contract, would be the same the General Public would pay for same type of purchase of the Units and to Install them, as per statement by the Contractor, therefore the Cost is determined to be Fair and Reasonable. 8. Description of Market Research: USCG checked in FEDLOG for availability, none to be available in search. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: The TMACC is a mobile unit that could possibly be requested to deploy and support emergency operations, having the AC Units would be a must. 10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the Acquisition: None at this time. 11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required: None at this time. 12.Contracting Officer's Certification: I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
