Senior Law Enforcement and Rule of Law Coordinator (LE/ROLC) ISSUANCE DATE: 06/08/2011 CLOSING DATE: 07/08/2011 SOLICITATION NUMBER: PSC-11-038-INL Gentlemen/Ladies: SUBJECT: Solicitation for a PSC to serve under DOS in INL. The United States Government (USG), represented by the DOS, is seeking proposals (OF 612's) from U.S. citizens interested in providing the PSC services described in the Statement of Duties. Submissions shall be in accordance with the information provided herein and at the place and time specified. JOB DESCRIPTION: See below US Personal Services Contract US Department of State Bureau for International Narcotics & Law Enforcement Affairs American Embassy Mexico City, Mexico Narcotics Affairs Section (NAS) STATEMENT OF DUTIES GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT AND RESPONSIBILITIES OF THE CONTRACTOR The Bureau of International Narcotics and Law Enforcement Affairs (INL) manages multiple justice and law enforcement, professionalization programs in Mexico that total over $115 million annually. INL is responsible for the development, supervision, coordination, and implementation of international narcotics control assistance activities and international criminal justice issues for the Department of State (DOS). INL's foreign assistance programs are designed to complement Mexico's efforts to establish a functional justice and public security system. Program activities include: 1. institutional capacity building; 2. professionalizing justice sector personnel through legal education and training initiatives; 3. fostering coordination within the criminal justice system, especially between police, prosecutors, courts, and prisons; 4. creating conditions under which Mexican constitutional and international human rights' guarantees can be upheld; and 5. extending the formal justice system throughout the country, while working with the traditional systems to increase public awareness and access to justice. Purpose A complex program of this size requires management; as it is vital to U.S. foreign policy goals and requires a joint Law Enforcement and Rule of Law Justice Advisor with significant management and legal expertise to develop, manage, and monitor all aspects of the program. The Senior Law Enforcement and Rule of Law Coordinator (LE/ROLC) will supervise the relevant six program coordinators and provide advice and assistance to US Embassy and Narcotics Affairs Section (NAS) Front Office (FO) to ensure the successful implementation of U.S. foreign assistance programs in Mexico. The Senior LE/ROLC is a key member of the Embassy's Rule of Law (ROL) Working Group and will lead the Security Forces Professionalization Working Group. Relationship The Senior LE/ROLC will serve under the day-to-day direction of the NAS Director. All employees under Chief of Mission (COM) authority assigned Law Enforcement and ROL duties will work with the Senior LE/ROLC to insure oversight and non-duplicative efforts in the Mission. In addition, the Senior LE/ROLC will supervise the coordinators for Ciudad Juarez, Corrections, Intelligence Programs, Law Enforcement Professionalization, Rule of Law, and Internal Controls. The Senior LE/ROLC will facilitate coordination with the Department of Justice (DOJ), Department of Homeland Security (DHS), and United States Agency for International Development (USAID) staff through the U.S. Embassy's Working Groups on the ROL and Security Forces Professionalization. The Senior LE/ROLC will be rated by NAS Director and reviewed by the Deputy Chief of Mission (DCM). Duties and Responsibilities • Oversee the operations of INL's criminal justice programs and to provide advice and counsel to Washington based staff to improve long term planning and support for our programs. • Serve as the liaison with various U.S. Government (USG) agencies and international entities working on law enforcement, rule of law, and institutional development focusing specifically on criminal justice and corrections. • Work at the senior level of the NAS LE/ROL and bi-national Merida team to build unity of effort across all agencies and across national boundaries. • Work effectively under pressure, within short time constraints, and during times of rapidly developing events. • Work with NAS Coordinators, Embassy Law Enforcement Committee (LEC), and outside consultants, to design and develop a USG Law Enforcement and ROL assistance strategy on Mexican security force and judicial development in the context of USG assistance. • Supervise and direct assessments of justice sector, public security forces, and corrections systems as needed. Supervise contributions to ROL components of DOS assessments and evaluations. • Design and supervise the development of programs in the ROL and capacity building areas that will advance US goals in Mexico by building strong institutions. • Supervise the project coordinators for Ciudad Juarez Corrections, Intelligence, Law Enforcement Professionalization, ROL, and Internal Controls Programs. Provide mentoring and direct operational guidance to the Senior Coordinator for each area as they organize and carry out the programs. • Monitor, coordinate, and appropriately guide INL contractor's activities in relevant program areas to ensure foreign assistance priorities set by the USG are being fulfilled. • Design, develop, and write contract proposals, bilateral letters of agreement, and budget plans. • Contribute to the ROL components of program coordinators assessments and evaluations. • Ensure unity of effort and purpose among USG LEC, NAS, USAID, contractors, and DOJ / Overseas Prosecutorial Development Assistance and Training (OPDAT) in implementing relevant programs. • Lead the bi-weekly security force development working group meeting and contribute to the bi-weekly Rule of Law (ROL) working group meeting. • Ensure close coordination with Mexican government organizations (e.g., Attorney General's Office, Federal Police, Federal Judiciary, Corrections authorities, and state and local entities in Ciudad Juarez) in the development and conduct of relevant programs. • Maintain awareness of and facilitate engagement of the range of ROL programs, including INL's justice and corrections programs, Mexican ROL Project/Justice Sector Development (AID), and DOJ-sponsored initiatives. • Develop and maintain contact with members of the international community, non-governmental organizations, the United Nations, Organization of American States (OAS), and other countries active in ROL and training sectors. • Conduct and/or update assessments of the informal and formal justice sectors, public security forces, and corrections systems as needed. • Monitor and express professional opinions on the quality and scope of INL justice programs, including evaluating programs for compatibility with U.S. and Mexican law. • Capture lessons learned for future US law enforcement training missions to the Mexican states on rapidly developing events. • Write regular reports and cables as directed by INL detailing pertinent activities in the justice sector and security forces. • Oversee all "one pagers" to INL to insure linkage between performance metrics and program outcomes. • Assist with the production of required reports such as the International Narcotics Control Strategy Report (INCSR). • Make Embassy LEC aware of the status of national programs; ensure coordination with them for planning and providing correct guidance. • Complete FSI Course PA-178, Contracting Officer's Representative Training. Complete all refresher training as required by Department of State (DOS). Minimum Requirements 1. U.S. citizenship, with the ability to obtain/maintain a DOS security, medical, and ethics clearance 2. JD from an accredited law school or a Masters Degree in a subject related to the criminal justice field from an accredited university 3. Ten (10) years of experience in the judicial and/or security forces field 4. Ten (10) years of senior level managerial experience in an international environment 5. Superior negotiation, interpersonal, and managerial skills 6. Experience in planning, strategizing, implementing, and reporting on projects 7. Proficient in Microsoft office Suite 8. Excellent oral and written English communication skills 9. Level 3, oral and written Spanish communication skills 10. Serve as a Contracting Officers' Representative and maintain eligibility of service Preferred Knowledge and Skills 1. Experience working with developing nations 2. Knowledge of accusatorial law and the Mexican civil law system 3. Overseas experience working with international organizations in implementing rule-of-law projects 4. Experience prosecuting international criminal cases 5. Experience in domestic and international criminal legal systems 6. Experience working at a U.S. Embassy, the U.S. Department of State or other legal-development organization 7. Strong understanding of U.S. foreign policy and interagency process 8. Knowledge of U.S. foreign policy regarding the continued development of justice reform and capacity-building, institutional development and demonstrated experience managing large U.S. assistance programs 9. Ability to work effectively with host-nation counterparts, departments, and ministries to further US program goals and objectives and communicate those issues in a timely and concise manner 10. Familiarity with international organizations involved in justice program components in missions around the world, and demonstrated understanding of the requirements for coordinating U.S. programs with them Evaluation Factors Factor 1: Proven ability to supervise project coordinators and build strong teams in the fields of training, rule of law, corrections, intelligence, internal controls, and state and local law enforcement. (30%) Factor 2: Ability to build unity of effort with members of relevant USG agencies, Host National representatives, and the international community in developing and coordinating justice programs. (20%) Factor 3: Ability to provide subject matter expert and policy guidance to senior level policy makers within the Embassy and INL. (20%) Factor 4: Experience and ability to assess current programs and assist in developing and implementing plans and performance measures for improving U.S. capacity to implement training and related judicial programs. (10%) COMPENSATION Compensation for the position will be negotiated as follows: Level of experience will dictate the salary level within the grade range. Entry-level salary will normally be at the first step of the grade range for the position. However, consideration will be given to the successful applicant's experience that is specifically relevant to the position to be filled. Number of years of relevant experience will determine at what step within the grade range the successful applicant will be compensated.
