- This is a combined synopsis/solicitation in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number A11PS00509 is issued as a request for quotation (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-48. The complete text of any provisions and clauses may be accessed in full text at http;//farsite.hill.af.mil. The solicitation is a 100 percent set aside for small business under NAICS code 621340. 001) The contractor shall provide all supplies, materials and personnel to provide Occupational Therapy Services, Occupational Therapist Register/Licensed to the Turtle Mountain Schools, Belcourt, North Dakota Estimated Number of Hours = 1592 1592 Hours @ ______________________ = ___________________________ In accordance with the Scope of Work SCOPE OF WORKThe Occupational Therapist Registered/Licensed (OTR/L) must be licensed in the state of North Dakota. The OTR/L will provide occupational therapy to students with disabilities as needed in a regular school day and provide extended school year services. The hours of Occupational Therapy (OT) services may increase or decrease based upon the students Individual Education Plan (IEP) student count and/or student attendance. BACKGROUNDOccupational Therapy Services will be required one to five days per week, from 2-8 hours per day, during the regular school term and will include the extended school year. CONTRACTOR TASKS:1. Contractor shall perform services for Turtle Mountain Special Education (TMSE) that will conform to all Tribal (TERO), State and Federal regulations including No Child Left Behind and Individuals with Disabilities Act (P.L. 108-446).2. On or before the tenth of each month, the contractor shall submit a statement to the TMSE indicating the charges for services rendered for the previous month. The actual fee to be fixed are to be mutually agreed upon by both parties, and any change in fee shall include a three month advance notice. Occupational Therapy services will be provided 2-8 hours per day 5 days per week for the 2011-2012 school year, these services will be based on the number of students with disabilities IEP. Services may include charting, attendance at various special education meetings pertaining to student placement and services, preparation time and other meetings as necessary. Contractor agrees to perform its said work in strict accordance with currently approved methods and practices in its professional specialties. The parties agree that all Occupational Therapy services rendered will be in accordance with ethical and professional standards. It is further agreed and understood between the parties that the sole interest of TMSE is to ensure that Occupational Therapy services shall be performed and rendered in a competent, efficient and satisfactory manner.4. The relationship between TMSE and the Contractor is that of independent contractors. The Contractor (OTR/L) shall not be considered as an employee agent or representative of the TMSE for any purpose whatsoever.5. The Contractor will not seek third party reimbursements for occupational therapy services rendered to TMSE.6. The Contractor will be responsible for all benefits, FICA applicable taxes, worker's compensation and unemployment insurance. TMSE will incur no further liability beyond the hourly rate paid to the Contractor for the occupational therapy services.7. In the event that the Contractor cannot fulfill the obligations of the contract, a two week notice (if applicable) will be given to TMSE. Every effort will be made to fill the position and re-instate service as quickly as possible. TURTLE MOUNTAIN SPECIAL EDUCATION WILL PROVIDE:1. Based upon students with disabilities, IEP, adapted equipment and supplies will be furnished and maintained by the TMSE. The provisions at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. Additionally, 52.212-1, Addenda are included, which provides definitions, specific instructions concerning pricing for this requirement, and additional information to provide with the quote. The provision at 52.212-2, Evaluation -- Commercial Items are not applicable. The Government intends to award a contract based on technical, past performance and price. Technical past performance when combined are more important than price. The Offeror shall supply at least three (3) contracts completed during the past three years or currently in process for the same services as are being solicited under this solicitation. Contracts listed may include those entered into by the Federal Government, agencies of the state and local governments, foreign governments, and commercial customers. Offeror(s) must include their, DUNS number and a completed copy of FAR 52.212-3 with their quote or indicate that they have completed the On-line Representations and Certifications Application (ORCA) and that it is up to date. Contract clause 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition. No addenda are issued to this clause. Contract clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition.
