Adobe Version of Solicitation Solicitation Number: DOL111RQ21267 (Please see Attached.PDF version of Solicitation) This is a combined synopsis/solicitation for a commercial service prepared in accordance with the format in Federal Acquisition Regulations (FAR) Part 12.6 and (FAR) Part 13 as supplemented with additional information included with this notice. This announcement constitutes the only solicitation and a written solicitation will not be issued. Firm, Fixed-price offers are requested under this Request for Quotation (RFQ). This document incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2005-50. The prevailing Department of Labor Wage Determination applies. This solicitation is set-aside 100% for small business. The Product Service Code is R421, and the associated North American Industry Classification System (NAICS) Code is 561492. The small business size standard is 5,200,000. 1. REQUIREMENT: The U.S. Department of Labor Employee Benefits Security Administration has a requirement for court reporter services for the period of 1 July 2011 to 30 June 2014. The Department of Labor Wage Determination WD 05-2104 (Rev.-12) 22 June, 2010 is applicable to this requirement. Interested parties may submit quotes via email only no later than 3 June, 2011 at 3:00 P.M. Eastern Time. Questions and other requests for information concerning this solicitation must be submitted to Rhodia.Keith.L@dol.gov no later than noon 1 June, 2011. Submit quotes to Rhodia.Keith.L@dol.gov. The Government intends to award a single Blanket Purchase Agreement to the eligible, responsible offeror whose quote conforms to the solicitation and provides the best overall value to the Government. EVALUATION FACTORS The Government will evaluate the Contractor(s) past performance, price and technical proposal as follows: Past experience - Demonstrated expertise in similar work within the past three years. Provide three references. Price - Aggregate value of proposal, to include overtime pricing, any additional cost for supplying original paper transcript and one copy. Technical- Proposal must demonstrate that the vendor is capable of performing satisfactorily, able to meet performance standards identified in the statement of work and will be available for the duration of work. Technical and past experience when combined is equal to pricing. BLANKET PURCHASE AGREEMENT CLAUSES Description of Agreement: Contractor shall furnish all labor to provide court reporter services. Extent of Obligation: The Government is obligated only to the extent of authorized purchases actually made under the BPA. Purchase limitation: The government will only be obligated to the extent of authorized purchases actually made in accordance with the BPA, and shall only pay for actual quantities received. Each individual call shall not exceed $10,000 and the maximum authorized limit of the BPA shall not exceed $50,000 annually. The BPA will specify individuals authorized to place calls. Additional information pertaining to delivery of services and invoicing procedure will be provide at time of award. STATEMENT OF WORK Request for Court Reporter Services for U.S. Department of Labor Employee Benefits Security Administration 1 July 2011-30 June 2014 The Employee Benefits Security Administration seeks the services of a court reporter for the period 1 July 2011-30 June, 2012 for the following: 1. Meetings of the Advisory Council on Employee Welfare and Pension Benefit Plans (about 10 days/year) 2. Hearings on regulations (uncertain number of days) 3. Depositions (uncertain if or how often this need will arise) The common objective is to obtain transcripts of proceedings on a timely basis. It is vital that the transcript be accurate regarding speaker attribution and reasonably accurate (within standards for court proceedings and advisory committees) for the words that are spoken. The location for the transcribing services generally is 200 Constitution Ave. NW, Washington, DC. DESCRIPTION OF SERVICES The court reporter services requested are as follows: Attend meetings, record proceedings, and make audio recordings available for review Transcribe recordings, with accurate speaker attribution Transmit draft transcripts electronically as a Word document within 5 days of meetings (this could vary, but will be specified before each meeting) in size 12 Courier font (normal spacing), 25 lines per page (exclusive of page number), on 8-1/2 X 11 inch paper with ruled margins of 1-3/4" at the left side and 1" at the right side Make requested corrections and print and bind final transcripts E-mail the final version in Word and pdf to EBSA Section 508 compliant Provide one original transcript and one copy by UPS delivery (within 2 days of when corrections are submitted) Provide copy of audio recording upon request DESCRIPTION OF SEPARATE TASKS The separate characteristics are as follows: The Advisory Council on Employee Welfare and Pension Benefit Plans (known as the ERISA Advisory Council) holds meetings on approximately 10 days per year. These meetings are held in a DOL conference room. One meeting is a teleconference, in which there is a DOL conference room with a speakerphone for the court reporter and the public. There are 15 members of the ERISA Advisory Council who attend the meetings. The Council invites witnesses (5-14 per day) to make presentations during the proceedings. The meeting dates will be provided when they are scheduled. The meetings generally start at 9 am and last until approximately 5:30 pm, with a one-hour break for lunch. Meetings dates will be provided when scheduled. Regulatory Hearings are held by the Employee Benefits Security Administration from time to time. These hearings may last one or two days, depending on the number of speakers. EBSA cannot project the number of hearings, nor whether there will be hearings, in any given year. The meeting dates will be provided when they are scheduled. Depositions in legal cases may be requested from time to time. The depositions may or may not occur in the Washington, DC area. It is not necessary for a court reporter providing services under this contract to provide the services outside the Washington, DC metropolitan area. The Council is subject to Federal Advisory Committee Act (FACA) rules, so should, if possible, provide at least one reference for work for a federal advisory committee. Also, they should indicate if they qualify as a small business, hubzone small business, emerging small business, or disabled veteran-owned small business, and provide DUNS and GSA information.
