Description
Notice of Intent to Sole Source This is Notice of Intent number HTC711-11-Q-D045. The Government intends to solicit and negotiate on a sole source basis with Rockwell Automation, for an Arena Software license under the authority of FAR 6.302-1. This will be in accordance with the format in FAR 12.6, in conjunction with FAR 13.5, as applicable, and as supplemented with additional information included in this notice. Quotes are not being requested and a written solicitation will not be issued. This acquisition will be processed under Simplified Acquisition Procedures (SAP). The North American Industry Classification System (NAICS) code for this procurement is 423430 and the small business size is 100 employees. Rockwell Automation is the only known supplier of Arena software as required by the Agile Transportation for the 21st Century (AT21) program management office. The Arena software is a proprietary product of Rockwell Automation. There are no similar products available through other companies that will satisfy the Government's requirement. Previous Joint Distribution Planning and Analysis Center (JDPAC) simulations have utilized Arena; although the version we currently use is nearly 10 years old. An updated version of Arena would allow us to continue to run the existing models. In addition to the main simulation function, our analysts have utilized Arena's distribution-fitting feature. Staying with the same software package would allow our analysts to continue supporting various studies in a timely manner without the additional time and cost spent to learn new simulation software. Based on the market research, no company other than Rockwell Automation can provide the necessary software products for the requirement. FOB Point is Destination, Scott AFB, IL. Delivery location is TCAQ, 508 Scott Drive, BLDG. 1900W, Scott AFB, IL 62225. Provisions and clauses included are those in effect through Federal Acquisition Circular 2005-51, dated 1 April 2011. The following FAR and DFARS provisions and clauses apply to this acquisition: FAR 52.204-7(b)(1), By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract resulting from this solicitation; FAR 52.212-1, Instructions to Offerors Commercial Items; FAR 52.212-2, Evaluation of Commercial Items; FAR 52.212-4, Contract Terms and Conditions Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items; DFARS 252-204-7004, Alternate A Central Contractor Registration; 252-212-7001, Contract Terms and Conditions Required to Implement Statutes of Executive Orders Applicable to Defense Acquisitions or Commercial Items (DEVIATION). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall have posted their FAR 52.212-3, Offerors Representations and Certifications Commercial Items at website http://orca.bpn.gov. This notice of intent is not a request for competitive proposals. Information received will normally be considered solely for the purpose of determining whether to conduct any future competitive procurement.
