Request for Justification and Approval for Other Than Full and Open Competition DEPARTMENTOF VETERANSAFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center, 5000 W National Avenue Bldg 5, Milwaukee WI 53295 This is a "Justification for Other Than Full and Open Competition." The purchase request 2237 transaction number is 556-11-2-2450-0016. 2.Nature and/or Description of the Action Being Processed: The Federal Health Care Center (FHCC) has a requirement for CRNA services 40 hours per week Monday through Friday, 7:00 a.m. to 3:30 p.m. or 8:30 a.m. to 5:00 p.m. (the tour of duty is negotiable). Plus take call every 5th weekend from Friday at 5:00 p.m. to 7:00 a.m. Monday and also provide up to 5 days of weekday night call per month from the hours of 5:00 p.m. to 7:00 a.m. On Call Surgical Services has satisfactorily provided these services to the FHCC under contract number VA69D-P-0869 from February 15, 2009 through February, 28, 2011. 3. Description of Supplies/Services Required to Meet the Agency's Needs: It is recommended to award a firm fixed price follow on contract to On Call Surgical Services for the period of 5/1, through 9/30/2011 with one 6 month option to extend services. The estimated value for 5/1, through 9/30/2011 is $210,000. The estimated value for 6 month option period is $210,000. The total value with option is $420,000. 4. Statutory Authority Permitting Other than Full and Open Competition: The VA's statutory authority to make sole-source awards to SDVOSBs is set forth at 38 U.S.C. sect. 8127, Pub. L. No. 109-461, 120 Stat. 3431, 3432 (2006). This authority allows the VA to award to an SDVOSB on a sole-source basis when: (1) such concern is determined to be a responsible source with respect to performance of such contract opportunity; (2) the anticipated award price of the contract (including options) will exceed the simplified acquisition threshold (as defined in section 4 of the Office of Federal Procurement Policy Act (41 U.S.C. 403) but will not exceed $5,000,000; and (3) in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers best value to the United States. 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Currently the FHCC has four operation rooms and only 3.7 FTEE anesthesia staff. Anesthesia is responsible for covering all surgical cases, ECT procedures, Cardiology procedures, Pulmonary procedures and GI procedures. The FHCC has requested to hire two Anesthesiologists/CRNAs however these requests have not been approved. This contract is required to maintain essential and continued anesthesia coverage at the FHCC, North Chicago, IL This coverage consists of 24/7 anesthesia coverage and is critical to direct patient care. On Call Surgical Services is a SDVOSB who has provided exemplary services on contract VA69D-P-0869 from February 15, 2009 through February 28, 2011. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A Sources Sought was completed which produced one not verified SDVOSB. The SDVOSB contacted contracting officer by phone in response to the sources sought expressing interest. However the sources sought specified a response in writing which was reiterated to the SDVOSB. No written response received. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The prior contract was awarded to this SDVOSB and determined to be fair and reasonable based on FSS contractor rates. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A sources sought was conducted with one not verified SDVOSB response. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Previous recruitment has been lengthy and unsuccessful as this requirement has been identified as a shortage category and difficult to fill. An Open and Continuous vacancy announcement will be open until the requirement is filled. This is a critical requirement than cannot be left open during a period of recruitment due to direct patient care needs. Use of contract staff will be utilized until permanent staff can be obtained. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Three FSS contractors are as follows: Harris Medical Associates, LLC Staff Care Inc. Jackson & Coker, LLC One SBA-certified 8(a), Small Disadvantaged Business SBA-certified 8(a), Small Disadvantaged Business: Choctaw Enterprises 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None 12.
