Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION JUSTIFICATION 1. Contracting Activity: CENTCOM Contracting Command (C3), Leatherneck Regional Contracting Center (LRCC), Camp Leatherneck, Afghanistan, FPO AE 09372. 2. Description of Action: This is a new Firm-fixed price contract using FY 2011 OMMC funds and FY 2011 R&D funds. 3. Description of Supplies/Services: The supplies to be procured are 27,500 ballistic undergarments. The total value is $2,007,500. 4. Authority Cited: 10 U.S.C. 2304(c)(2) as implemented by FAR 6.302-2; the agency's need for the property is of such an unusual and compelling urgency that the United States would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. 5. Reason for Authority Cited: I MEF (Fwd) and 10 th Mountain Division forces are sustaining significant injuries to the genital, perinea, and femoral artery areas as a result of combat operations and improvised explosive devices. The loss of forces due to these types of injuries has a significant impact on the unit's combat effectiveness and their ability to sustain operations. Based on analysis in theater, ballistic underwear will drastically improve casualty recovery and reduce secondary infections. Ballistic underwear is currently being used by British forces in Regional Command- South West and they have significantly less injuries to the genital and perinea areas. Currently, the Marines and Division soldiers do not have any issued equipment to protect the perineum and genital areas. Without ballistic undergarments, I MEF and 10 th Mountain forces will continue to suffer significant injuries, loss of life, resulting in an adverse effect on combat operations. 6. Efforts to Obtain Competition: Due to the limited timeframe to procure the requirement the Contracting Officer conducted internet searches and while other similar products existed, there were other garments that could be worn under uniform clothing providing the same benefits. No other product met the requirements and had been battlefield tested. Since the procurement was of an immediate need to reduce the impacts and lose of life from exposure to blast fragments, there was no time available to develop data comparable to what already exists for the product being procured under this justification. 7. Actions to Increase Competition: For future procurements of ballistic undergarments it is anticipated that it will be done CONUS under normal procedures. 8. Market Research: Other sources can provide different types of ballistic undergarments; however this is the only source that provides the antimicrobial double-weave silk undergarments that have been battlefield tested. Through our research we discovered no other source that provides a battlefield tested undergarment. 9. Interested Sources: At this time we do not know of any other interested sources that can meet the requirement. We expect more sources to enter the marketplace as the demand for ballistic undergarment increase. 10. Other Facts: I MEF has coordinated with Marine Corps Systems Command for purchase of ballistic underwear. An Urgent Universal Needs Statement has been submitted for approval and subsequent fielding to the Marine Corps; however, there is an immediate combat need and further delay may result in injuries or loss of life that could have been prevented. The Army is in the process of identifying and approving a complete system to address the area of concern identified above. However, the Army is using the procurement to conduct battlefield testing and evaluation. 11. Technical Certification: I certify that the supporting data under my cognizance which are included in this justification are accurate and complete to the best of my knowledge and belief. 12. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Prices for this purchase are comparable to public sources researched through internet pricing. 14.
